This Law establishes the legal basis of activities in the field of geodesy and cartography and is directed to creation of conditions for requirements satisfaction of the state, citizens and legal entities in cartographic products, and also conditions for functioning and interaction of public authorities of the Kyrgyz Republic in the field of geodesy and cartography.

CHAPTER I. GENERAL PROVISIONS

Article 1. Basic concepts

For the purposes of this Law the basic concepts are used:

geodesy - area of the relations arising in the course of scientific, technical and productive activity by determination of figure, the sizes, gravitational field of Earth, coordinates of points of the land surface and their changes in time;

cartography - area of the relations arising in the course of scientific, technical and productive activity on studying, creation and use of cartographic works which body are cartographic images;

activities in the field of geodesy and cartography (land, cartographic, aero photofilm-making activities and engineering and geodetic researches) - scientific, technical, productive and management activity in the field of geodesy and cartography;

geodetic and cartographic works - process of creation geodetic and cartographic products, materials and data;

kartografo-geodetic fund - set of the materials and data created as a result of implementation of geodetic and cartographic activities and subjects to long-term storage for the purpose of their further use;

cartographic products - topographic maps and plans of all scales, thematic cards, atlases, space and aerial photographs, photoplans, forms, reproductions of cap installation, etc.;

geodetic products - catalogs of coordinates of geodetic Items, catalogs of heights of leveling Items, magazines of measurements, sheets and other materials of equalization, sketch map of Items, schemes of placement of Items, etc.;

geodetic Item - Item on the area on which geodetic coordinates are determined;

astronomo-geodetic Item - geodetic Item on which the width, longitude and azimuth are determined;

leveling Item - Item on the area on which absolute height is determined;

gravimetric Item - Item on the area on which gravity is determined.

Article 2. Legal regulation in the field of geodetic and cartographic activities

This Law governs legal relations in the field of geodetic and cartographic activities.

The property and related personal non-property relations arising in the course of geodetic and cartographic activities are regulated by the civil legislation of the Kyrgyz Republic.

The conventional principles and rules of international law and the international agreements of the Kyrgyz Republic in the field of geodetic and cartographic activities are component of system of law of the Kyrgyz Republic.

The international agreements of the Kyrgyz Republic are applied to the relations in the field of geodetic and cartographic activities directly, except as specified, if follows from the international treaty of the Kyrgyz Republic that its application requires adoption of the interstate act.

If the international treaty of the Kyrgyz Republic establishes other rules, than those which are provided by this Law are applied rules of the international treaty.

Article 3. Geodetic and cartographic activities

Geodetic and cartographic activities, proceeding from purpose of the performed works, include:

geodetic and cartographic works of the state appointment which results have nation-wide, cross-industry value;

geodetic and cartographic works of special (industry) purpose which need of carrying out is determined by requirements of administrative-territorial educations, separate industries, citizens and legal entities.

Treat geodetic and cartographic works of the state appointment:

determination of parameters of figure of Earth and its external gravitational field;

creation, development and maintenance in working order the state leveling and geodetic networks, including gravimetric, fundamental and the first class which density and accuracy provide creation of the state topographic maps and plans, the solution of nation-wide, defense, research and other tasks;

creation and updating of the state topographic maps and plans in graphical, digital, photographic and other forms, the accuracy and which content provide the solution of nation-wide, defense, research and other tasks; edition of these cards and plans;

use of remote sensing of Earth for the purpose of ensuring geodetic and cartographic activities;

geodynamic researches based on geodetic and space measurements;

creation and maintaining the state kartografo-geodetic fund;

creation and maintaining geographical information systems of the state and regional appointment;

designing, creation and edition of all-geographical, political and administrative, scientific and help and other thematic cards and atlases of cross-industry appointment, education cartographic guidances;

carrying out geodetic, cartographic, topographical and hydrographic works for the purpose of ensuring defense and safety of the Kyrgyz Republic;

geodetic, cartographic, topographical, hydrographic support of delimitation, demarcation and check of passing of the line of frontier of the Kyrgyz Republic;

mapping of bottom of internal reservoirs, creation of topographic and special maps of reservoirs of the Kyrgyz Republic;

metrological support of geodetic, cartographic, topographical works;

standardization, accounting and streamlining of the use of place names;

accomplishment of research and design works on the directions specified in this part.

Treat geodetic and cartographic works of special (industry) purpose:

creation and updating of the topographical plans intended for creation of master plans of sites of construction of different objects, underground networks and constructions, binding of buildings and constructions to sites of construction and also for accomplishment of other special works;

creation and maintaining geographical information systems of special purpose;

creation of thematic cards, plans and atlases of special purpose in graphical, digital and other forms; edition of these cards, plans and atlases;

geodetic, topographical, aero photofilm-making and other special works in case of engineering researches, construction and operation of buildings and constructions, land surveying of lands, maintaining inventories, design and survey and other special works;

accomplishment of research and design works on the directions specified in this part.

Article 4. Subjects and objects of legal relations in the field of geodetic and cartographic activities

Subjects of legal relations in the field of geodetic and cartographic activities (further - subjects of geodetic and cartographic activities) are the Kyrgyz Republic, administrative-territorial educations, citizens and legal entities.
