About approval of the Regulations on funds of development and material security of authorized antimonopoly authorities

For the purpose of implementation of article 20 of the Law of the Kyrgyz Republic "About natural monopolies in the Kyrgyz Republic", according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on funds of development and material security of authorized antimonopoly authorities according to appendix.

2. This resolution becomes effective after fifteen days from the date of official publication.

Regulations on funds of development and material security of authorized antimonopoly authorities

1. General provisions

1. Funds of development and material security of authorized antimonopoly authorities (further - funds) are created for the purpose of strengthening of material and technical resources, creation of necessary conditions for work and ensuring social protection of staff of the State agency of anti-monopoly regulation under the Government of the Kyrgyz Republic and State agency on regulation of fuel and energy complex under the Government of the Kyrgyz Republic (further - antimonopoly authorities).

Funds in the activities are guided by the Law of the Kyrgyz Republic "About natural monopolies in the Kyrgyz Republic", the regulatory legal acts which are not contradicting the legislation of the Kyrgyz Republic and this Provision.

2. Procedure for formation of means of Funds

2. Means of Funds are created due to financing of account part of the republican budget according to the annual retrospective analysis of last years in the amount of 10 percent from the variation amount from the regulating requirements which arrived in the republican budget for previous year. Within year adjustment of the specified amount towards increase or reduction based on the reconciliation statement of actually arrived means in the republican budget for the current year at the rate to 25 percent is made.

3. Procedure for use of means of Funds

3. Means of Funds are used on:

- development, release, acquisition of booklets, brochures and other specialized literature, including on electronic media, on the questions relating to activities of antimonopoly authorities;

- organization of training of staff of antimonopoly authority;

- participation in work of national authorities and the international organizations concerning protection and development of the competition, anti-monopoly regulation, consumer protection, advertizing, and also to other questions carried to competences of antimonopoly authority;

- payment of research works on creation of standards, techniques, managements, etc.;

- expenses on the organization and holding welfare and sporting events, formal meetings, seminars, conferences, charitable actions;

- fee, the provided by consulting, estimative, auditing, legal and other organizations, works of experts and specialists, including foreign, having right to be engaged in accomplishment of certain works and services by hearing of cases in violations of the law, conducting checks and examinations, and also project development of the regulatory legal acts having the right to be engaged in accomplishment of the certain works and services involved on contractual basis in case of business necessity;

- organization of events, directed to improvement of activities of antimonopoly authority;

- development and strengthening of material and social base of antimonopoly authority for ensuring effective activities, including on acquisition of office motor transport;

- acquisition of the computer equipment, office equipment, means of communication, furniture, repair and maintenance;

- awarding of employees based on the relevant orders of directors of antimonopoly authorities;

- surcharge to the salary to workers, the acting as on position of temporarily absent workers, technical and junior service personnel;

- rendering one-time financial support for medical and other purposes, accomplishment of other obligations according to the collective agreement signed between employers and representative bodies of employees of antimonopoly authorities;

- payment of cost of food and journey in city boundaries, the area, area for implementation of functional obligations;

- establishment of allowances for irregular working hours according to the labor law to salaries for junior and technical service personnel;

- payment of traveling expenses, regarding compensation of actual expenses, according to the procedure, established by the labor law of the Kyrgyz Republic.

4. Accounting treatment and reporting

4. The expenditure of means of Funds is made according to the approved expense budgets and actual receipt of the income.

5. Manager and the responsible person for use of means of the relevant fund is the director of antimonopoly authority.

6. The relevant structural divisions of financial accounting of antimonopoly authorities perform accounting of forming (receipt), distribution of means of funds, control of target use of means according to the estimate appointments approved in accordance with the established procedure and submission of reports on the managers of funds specified to means according to the legislation of the Kyrgyz Republic.
