I ORDER:

1. Determine that issue of individual licenses on implementation by residents of property investments outside Ukraine performs department of state regulation of foreign economic activity of department of regulation of foreign economic activity.

3. Approve:

Procedure for acceptance and consideration of the Ministry of Economic Development and Trade of Ukraine of documents for receipt of individual licenses for implementation by residents of property investments outside Ukraine which is applied;

form of the individual license on implementation of property investments outside Ukraine;

expense budget of the Ministry of Economic Development and Trade of Ukraine, connected with registration and issue of individual licenses on implementation by residents of property investments outside Ukraine.

4. Determine that individual licenses outside Ukraine have the right to sign the First Deputy Minister, the deputy minister - the chief of staff, the deputy minister according to distribution of obligations to implementation by residents of property investments.

5. To inspection department behind foreign economic activity of department of the external economic policy (Zhizhko O. A.) together with the head legal department (Medvetsky A. T.) submit this order on state registration to Ministry of Justice in the time established by the legislation and provide its further maintenance.

6. To inspection department behind foreign economic activity of department of the external economic policy (Zhizhko O. A.) together with administrative department (A.I. Spark) after state registration of this order to bring it to permission of the State Customs Service of Ukraine, the State committee of statistics of Ukraine, State Tax Administration of Ukraine, the National Bank of Ukraine, Fund of state-owned property of Ukraine.

Procedure for acceptance and consideration by the Ministry of Economic Development and Trade of Ukraine of documents for receipt of individual licenses for implementation by residents of property investments outside Ukraine

1. This Procedure determines acceptance and consideration of the documents necessary for receipt of individual licenses on implementation by residents of property investments outside Ukraine (further - the individual license), and also the bases for refusal in issue of the individual license and for its cancellation.

2. Action of this Procedure extends to all residents of Ukraine irrespective of patterns of ownership and place of registration.

3. The applicant is responsible for reliability of documents which are provided in the Ministry of Economic Development and Trade of Ukraine for receipt of individual licenses.

4. Consideration of the documents necessary for receipt of individual licenses is performed by department of state regulation of foreign economic activity with the assistance of department of legal support of foreign economic activity, and in case of requirement - other managements.

The Ministry of economic development and trade of Ukraine during consideration of documents obtains information on compliance of price conditions of implementation of property investment in the existing market situation from the state company "State Information and Analysis Center of Monitoring of the Foreign Goods Markets" or other specialized state enterprises, organizations and the organizations determined by the Cabinet of Ministers of Ukraine.

5. For receipt of individual licenses residents submit to the Ministry of Economic Development and Trade of Ukraine the documents determined by Item 3 of the Regulations on procedure for issue of individual licenses on implementation by residents of property investments outside Ukraine (further - the Provision) approved by the resolution of the Cabinet of Ministers of Ukraine of February 19, 1996 No. 229 (with changes and amendments). The specified documents are accepted in accordance with the established procedure by employees of development department of information and communication technologies, document flow and electronic services.

6. The documents filed with violation of requirements of the Provision are not accepted and return to consideration to the applicant.

Acceptance date of documents is put on the sheet address of the applicant.

7. Includes the documents of department of state regulation of foreign economic activity accepted in consideration in the book of accounting then the sheet of approval together with which documents are sent for consideration (examination) in department of legal support of foreign economic activity is attached to them, and in case of requirement - in other managements.

8. The departments specified in item 4 according to this Procedure and within the competence perform consideration of documents on such questions:

the department of state regulation of foreign economic activity considers documents on application to resident of special sanctions, the stipulated in Article 37 Laws of Ukraine "About foreign economic activity", and availability of the facts of violation of fixed terms of carrying out calculations for the external economic transactions;

the department of legal support of foreign economic activity performs examination of documents concerning compliance to their current legislation of Ukraine and to the international obligations of Ukraine;

the paragraph the fourth is excluded.
