According to part two of article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from implementation of economic activity in the field of creation is estimated, forming, maintaining and use of insurance fund of documentation and frequency of implementation of planned actions of the state supervision (control) by the Public archive agency, according to appendix is determined.

2. Declare invalid the resolution of the Cabinet of Ministers of Ukraine of October 30, 2014 No. 575 "About approval of criteria by which the risk degree from implementation of economic activity in the field of creation is estimated of forming, maintaining and use of insurance fund of documentation and frequency of implementation of planned actions of the state control by the public archive agency is determined" (The Official Bulletin of Ukraine, 2014, No. 88, the Art. 2520).

Criteria by which the risk degree from implementation of economic activity in the field of creation is estimated, forming, maintaining and use of insurance fund of documentation and frequency of implementation of planned actions of the state supervision (control) by the Public archive agency is determined

1. Criteria by which the risk degree from implementation of economic activity in the field of creation, forming, maintaining and use of insurance fund of documentation is estimated are:

value for economy and safety of the state;

belonging to critical infrastructure;

availability of potential level of danger;

belonging to cultural heritage;

appointment of insurance fund of documentation;

observance of requirements of the legislation for creation, forming, maintaining and use of insurance fund of documentation.

2. According to the established criteria subjects of managing treat one of three risk degrees - high, average and insignificant.

3. Subjects which correspond to the following criteria concern to subjects of managing with high risk:

have strategic importance for economy and safety of the state;

are contractors of the state defense order;

treat fuel and energy complex of Ukraine (producers of electrical and heat energy, products of oil refining and gas, the companies performing coal production, peat, oil and gas, delivery and oil transportation, gas and products of their conversion, suppliers of electrical and heat energy, etc.);

use the earth of rail, road transport and road economy, sea, river, air, pipeline transport and the urban electric transport;

ensure functioning of tailings dams, sludge collectors and stores of toxic waste;

use water objects of nation-wide value for requirements satisfaction of the population, the industry, agricultural industry, transport and other industries of economy, including water intake, dumping of sewage and other types of use of waters (water objects);

perform activities on the construction object carried to considerable class of effects (responsibility) - CC3;

provide storage of insurance fund of documentation;

perform activities in the territory and/or in the rooms of monument of cultural heritage of national value belonging to them on the property right, ownerships, uses;

have in property, ownership, use unique cultural values (items of the collection, meetings, funds) which are recognized as objects of national cultural property and are included in the State register of national cultural property;

allowed within year of violation of requirements of the legislation in the field of creation, forming, maintaining and use of insurance fund of documentation.

4. Subjects which correspond to the following criteria concern to subjects of managing with average risk degree:

perform production, delivery of heat energy and transportation of heat energy by local (distribution) thermal networks, transfer of electrical energy by local (local) power supply networks and supply of natural gas;

use water objects of local value for requirements satisfaction of the population, the industry, agricultural industry, transport and other industries of economy, including water intake, dumping of sewage and other types of use of waters (water objects);

treat rail, sea, river, road, air, pipeline transport, and also the urban electric transport and departmental transport;

treat the sphere of drinking water, water supply and water disposal;

have in property or in use at least one object of the increased danger;

perform activities on the construction object carried to middle class of effects (responsibility) - CC2;

perform production of documents of insurance fund of documentation;

perform activities in the territory and/or in the rooms of monument of cultural heritage of local value belonging to them on the property right, ownerships, uses.

5. The subjects of system of insurance fund of documentation which are not carried to subjects of managing with high and average risk degree concern to subjects of managing with insignificant risk degree.

6. If the subject of managing can be carried at the same time to two or more risk degrees, such subject belongs to more high risk from among to what it can be carried.

7. Planned actions of the state supervision (control) of activities of subjects of managing are performed with the following frequency:

with high risk - is not more often than once in two years;

with average risk degree - is not more often than once in three years;

with insignificant risk degree - is not more often than once in five years.

8. If by results of two last planned actions of the state supervision (control) the facts of violation by the subject of managing of requirements of the legislation in the field of creation, forming, maintaining and use of insurance fund of documentation are not elicited, the following planned event of the state supervision (control) concerning such subject is performed not earlier than through the period of time established for the corresponding risk degree, increased in time 1,5.
