ORDER OF THE MINISTER OF DEFENCE OF THE REPUBLIC OF KAZAKHSTAN

About approval of the Instruction for prevention of aviation incidents in the state aircraft

(as amended of the Order of the Minister of Defence of the Republic of Kazakhstan of 06.08.2020 No. 371)

According to the subitem 12) article 15 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and for the purpose of streamlining of activities of aeronautical personnel for prevention of aviation incidents in the state aircraft of the Republic of Kazakhstan PRIKAZYVAYU:

1. Approve the enclosed Instruction for prevention of aviation incidents in the state aircraft.

2. To provide to headquarters on supervision of aviation safety of the state aircraft of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan in paper and electronic views on the Kazakh and Russian languages within ten calendar days from the date of state registration;

3) placement of this order on Internet resource of the Ministry of Defence of the Republic of Kazakhstan after its first official publication;

4) the direction of data in Legal department of the Ministry of Defence of the Republic of Kazakhstan on execution of the actions provided by subitems 1), 2) and 3) of this Item within ten working days from the date of state registration.

3. Declare invalid the order of the Minister of Defence of the Republic of Kazakhstan of June 24, 2015 No. 360 "About approval of the Instruction for prevention of aviation incidents and incidents in the state aircraft of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts for No. 11990, it is published in information system of law of Ad_let on October 5, 2015).

4. To impose control of execution of this order on heads of controls of the state aircraft of the Republic of Kazakhstan.

5. Bring this order to service employees in the part concerning them.

6. This order becomes effective after ten calendar days after day of its first official publication.

The instruction for prevention of aviation incidents in the state aircraft

Chapter 1. General provisions

1. The instruction for prevention of aviation incidents in the state aircraft (further - the Instruction) is developed according to the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law).

2. The instruction disaggregates activities of aeronautical personnel of the state aircraft for prevention of aviation incidents.

3. The terms and determinations used in the Instruction:

1) air unit - the republican public institution performing the organization and accomplishment of flights of air vehicles of the state aircraft, their operation and storage;

2) aviation incident - the event connected with flight operation of the air vehicle which could create or created threat of integrity of the air vehicle and/or life of the people who are on its board, but did not end with aviation incident;

3) aviation activities - all types of activity directed to creation of conditions and use of airspace by the person by means of air vehicles;

4) aviation incident - the event connected with flight operation of the air vehicle which led to death (to bodily harm from the death) of the people who were onboard the air vehicle and/or loss of this air vehicle;

5) the air vehicle - the device supported in the atmosphere due to its interaction with air excepting interaction with the air reflected from earth's (water) surface;

6) flight operation of the air vehicle – the process of operation of the air vehicle covering the period from the beginning of carrying out the air vehicle by flight personnel of pre-flight inspection till the moment when all persons which were onboard with objective of the flight left the air vehicle (the moment of matching of the unmanned aerial vehicle);

7) No. 371 is excluded according to the Order of the Minister of Defence of the Republic of Kazakhstan of 06.08.2020

8) security service of flights of the state aircraft – the structural division of the Ministry of Defence of the Republic of Kazakhstan exercising the state control and supervision on safety issues of flights in the state aircraft of the Republic of Kazakhstan;

9) parts of providing – air technical bases, aviation commandant's offices, air traffic control centers, parts of communication and radio engineering providing, part of material logistics;

10) the warning of risk factor - oral and written informing service employees on risk factor with offers on its liquidation or reduction;

11) dangerous factor – any (real or potential) impact on any element of aviation system, capable to lead to emergence of aviation event;

12) authorized body in the field of the state aircraft - The Ministry of Defence of the Republic of Kazakhstan (further - authorized body);

13) controls of the state aircraft:

Management of the commander-in-chief Silami of air defense of Armed Forces of the Republic of Kazakhstan – in aircraft of the Ministry of Defence of the Republic of Kazakhstan;

The main command of National guard of the Republic of Kazakhstan – in aircraft of the Ministry of Internal Affairs of the Republic of Kazakhstan;

Air service of Committee of homeland security of the Republic of Kazakhstan – in aircraft of Committee of homeland security of the Republic of Kazakhstan;

14) security service of flights – the structural division as a part of control, air unit performing the activities directed to prevention of aviation incidents with the national air vehicles;

15) safety management system of flights – the system approach to safety management of flights including organizational structure, hierarchy (distribution) of responsibility, guidelines and procedures;

16) the service employee, authorized to make the decision - the service employee having rights to stop or suspend flights (the head of control of the state aircraft, the commander of air unit, the senior of flight change, the head by flights and higher commanders (chiefs));

17) risk factor – the predicted probability and gravity of effects of emergence of aviation event;

18) the voluntary (confidential) message – the transferred unofficial information on dangerous factors (risk factors) of aviation activities influencing safe accomplishment of flights.

Chapter 2. Activities of administrative board of controls and parts of the state aircraft for prevention of aviation incidents

Paragraph 1. Main actions of controls of the state aircraft for prevention of aviation incidents

4. The main actions of controls for prevention of aviation incidents are:

1) work planning on safety-of-life function on perspective, for year, for the accounting period, for month, to upcoming events;

2) work on identification and prevention of dangerous factors, collection, generalization and finishing information on them, development of measures for their prevention;

3) activities for safety management of flights;

4) the organization of flight and methodical work for the purpose of increase in professional skill of flight personnel;

5) periodic and target analyses of security status of flights;

6) control of the organization of flights on the eve of and during their carrying out.

5. The control on the eve of flights performs:

1) the analysis of the requests for flights and flights expected meteoconditions, condition of air vehicles, airfields, means of ensuring of flights;

2) analysis of correctness of creation of planned tables of flights;

3) verification of presence and conditions of necessary forces and means for carrying out flights;

4) LOC ARM check to flights of flight personnel, personnel of group managements of flights, air vehicles, airfields, means of ensuring of flights.

6. When implementing the analysis of the arrived requests for flights the following questions are considered:

1) general air picture for flights, possible crossings of routes of air vehicles of air units with airways of the Republic of Kazakhstan, the work plan of aircraft, time of the beginning and the end of flights;

2) compliance of training level of flight personnel to the expected airflow conditions for flights;

3) procedure for carrying out radar investigation of weather means of air units and receipt of aeronautical information from controls air traffic of civil aviation;

4) security of the forthcoming flights and flights with terrestrial radio engineering facilities;

5) readiness of personnel of groups of management of flights, compliance of training level of personnel to the expected airflow conditions;

6) availability (absence) of administrative board of control on places of the flight personnel controlling preparation, air vehicles, means of ensuring of flights;

7) readiness of the master and alternate aerodromes (helidromes, platforms), security of the forthcoming flights with material means;

8) readiness of polygons for flight servicing;

9) condition and readiness of forces and means of search and rescue;

10) completeness of performance of works, directed by the senior chiefs to execution before the next flights;

11) sufficiency of forces and means for carrying out flights;

12) readiness of air vehicles for flights (check, familiarization flights);

13) accomplishment on air vehicles of emergency bulletins of the industry and instructions for increase in reliability;

14) readiness of control centers of controls and parts for flight management and control of flights, handover procedures to the interacting controls air traffic.

7. LOC ARM check to flights of service employees of control is performed by the higher service employees designated by the corresponding head of control including with use of communicating device.

8. LOC ARM check to flights of commanders of air units is performed by their commanders (chiefs), other service employees of controls designated by heads of higher bodies of management.

9. Are subject to check:

1) the number of the flights planned for flight change and personal enhancement exercises of the Rate of combat (flight) training and as the instructor;

2) compliance of the planned flying missions to training level;

3) weather forecast on the forthcoming flight shift;

4) the reached and actual meteorological minimum, date of accomplishment of the previous flights in these conditions.

10. Control of the course of carrying out flights and flights is performed by controls continuously.

11. The most important issues resolved during flights and flights are:

1) ensuring high-quality radar and air reconnaissance and the additional exploration of weather, collection and data analysis about weather received on all communication channels;

2) the continuous analysis of airflow conditions and timely informing the parts participating in flights about the dangerous phenomena of weather and tendency to its deterioration;

3) assessment of conformity of the actual meteorological conditions to nature of the carried-out flights and training level of crews;

4) weather condition, readiness of controls, bonds and providing, and also personnel of group of management of flights on alternate aerodromes;

5) ensuring high-quality management, radio engineering control of flights from control centers flights of parts;

6) timely informing control centers flights of parts and personnel of groups of management of flights about crossing of routes and flying areas of air units air vehicles of other departments;

7) compliance of the carried-out route flights and flights approved to requests;

8) timely informing air units on the violations and aviation incidents revealed during flights.

12. The service employees of controls of the state aircraft exercising control of flights directly in air units pay special attention:

1) the methodical sequence of training and compliance of meteorological conditions to training level of the pilots who are carrying out flights after long breaks;

2) the organization of flights of the pilots for the first time fulfilling difficult types of flight training and also the pilots who arrived from aviation educational institutions or from other parts without allowing statement of excessive tasks and exceeding of loading by it in flight change;

3) to quality of management of flights by the personnel of group of management of flights having insufficient experience (including on management of flights on polygon), especially at night and in close meteorological conditions.

13. In case of identification of the violations menacing to aviation safety measures to elimination of these violations with the subsequent report on the revealed dangerous factors to the immediate superiors are taken.

Paragraph 2. Activities of heads (commanders, chiefs) of controls, air units and parts of providing the state aircraft on prevention of aviation incidents

14. The head (the commander, the chief) of control of the state aircraft organizes work on prevention of aviation incidents and activities for safety management of flights.

15. The head (the commander the chief) control of the state aircraft performs:

1) permanent management of all types of activity of subordinate structures connected with the organization of flights and their safe accomplishment;

2) management of service employees of subordinate security service of flights;

3) organization of timely and high-quality work planning for prevention of aviation incidents;

4) organization of system operation of safety management of flights;

5) timely decision making in case of receipt of the prevention

about risk factor and organization of carrying out the relevant preventive actions;

6) carrying out the systematic analysis of security status of flights on the basis of observations, reports and the arriving information;

7) assessment of activities of service employees for prevention of aviation incidents;

8) control of accomplishment of actions for safety-of-life function, their security with financial and material resources;

9) matching and organization of training of specialists of security service of flights;

10) level control of training of subordinate aeronautical personnel in safety issues of flights.

Paragraph 3.

No. 371 is excluded according to the Order of the Minister of Defence of the Republic of Kazakhstan of 06.08.2020

Chapter 3. Activities of heads and specialists of security service of flights in prevention of aviation incidents

Paragraph 1. General provisions

27. In controls of the state aircraft according to the decision of the head security service of flights is created.

28. Security service of flights is intended for implementation of the activities directed to holding actions for prevention of aviation incidents with air vehicles of the state aircraft.

29. Assignment of chiefs of security service of flights is made after approval of heads of higher bodies of aviation safety. Matching of service employees is carried out to security service of flights in coordination with chiefs (heads) of these bodies.

30. Functions of service employees of security service of flights are approved with the head of higher body of aviation safety and affirm direct heads (commanders, chiefs).

31. Subordinate security service of flights in the special relation submits to the head of higher body of aviation safety.

Paragraph 2. Activities of the head of security service of flights of the state aircraft

32. The head of security service of flights of the state aircraft within competence:

1) is appointed by carrying out in the state aircraft (in coordination with heads of controls of the state aircraft) checks of activities of aeronautical personnel of the state aircraft in the part concerning aviation safety;

2) stops aviation activities of the aeronautical personnel of the state aircraft of the Republic of Kazakhstan which allowed violations in the organization and carrying out flights of the state aircraft and use of airspace;

3) discharges of operation aviation engineering, controls and flight servicings in case of discrepancy of their condition to requirements of technical documentation;

4) participates in the events held by state bodies regarding the state aircraft concerning tasks on safety-of-life function;

5) is organized by evaluating condition of accident rate in the state aircraft, develops offers on prevention of aviation incidents, provides information to heads of state bodies on these questions;

6) coordinates the work of security service of flights of the state aircraft directed to increase in reliability of aviation system;

7) is organized by interaction with state bodies, security service of flights of civil and experimental aviation, research establishments and the organizations for investigation of aviation incidents and aviation incidents, safety-of-life function and increase in reliability of the national air vehicles;

8) requests necessary information on safety issues of flights from structural divisions of the Ministry of Defence, the General Staff of Armed Forces of the Republic of Kazakhstan, controls and air units and parts of providing the state aircraft.

Paragraph 3. Activities of heads of security service of flights of controls and air units of the state aircraft for prevention of aviation incidents

33. Head of security service of flights of control and air unit:

1) performs management of safety management system of flights;

Reveals 2) and analyzes dangerous factors;

3) in case of identification of dangerous factors which can exert impact on flight situation timely develops warnings of risk factors and brings them to service employees, representatives to make the decision;

4) is controlled by carrying out preventive actions on prevention of aviation incidents, remedial action and violations in the organization, accomplishment and flight servicing;

Develops 5) jointly with structural divisions of bodies of managements of the state aircraft of action for elimination or decrease in influence of dangerous factors, shortcomings and violations;

6) is organized by timely bringing to aeronautical personnel operational, periodic and represented on information request about aviation incidents and incidents;

7) organizes work of subordinate security service of flights on prevention of aviation incidents, exercise control of completeness of fulfillment of duties by specialists of these bodies;

8) estimates security status of flights;

9) is checked by condition of air vehicles, controls and flight servicing in air units and parts of providing.

10) instructs service employees aeronautical personnel on elimination of the revealed violations and shortcomings of the part concerning aviation safety with the report to the direct head (the commander, the chief);

11) stops aviation activities of the aeronautical personnel (according to the procedure of subordination) which allowed violations in the organization and carrying out flights in use of airspace, the menacing aviation safeties, with the subsequent report to the direct head (the commander, the chief);

12) discharges of operation aviation engineering, controls and flight servicings in case of discrepancy of their condition to requirements of technical documentation, with the subsequent report to the direct head (the commander, the chief).

Paragraph 4. Activities of specialists of aviation safety of the state aircraft for prevention of aviation incidents

34. Specialists of security service of flights:

1) provide functioning of safety management system of flights;

2) are revealed and analyze dangerous factors;

3) timely inform the head of security service of flights on risk factors in the presence of information on dangerous factors;

4) participate in development of actions for elimination or decrease in influence of dangerous factors, shortcomings and violations;

5) are involved in investigations of aviation events;

6) participate in checks of activities of aeronautical personnel, including training level of flight personnel in piloting technique, aerial navigation and fighting application;

7) is checked by condition of aviation engineering, controls and flight servicing in air units and parts of providing.

8) instruct service employees aeronautical personnel on elimination of the revealed violations and shortcomings of the part concerning aviation safety with the report to the direct heads (commanders, chiefs).

9) is issued by offers to the head of security service of the flights about suspension of aviation activities of aeronautical personnel which allowed violations in the organization and carrying out flights and use of airspace;

10) is issued by offers to the head of security service of flights about discharge from operation of aviation engineering, controls and flight servicing in case of discrepancy of their condition to requirements of technical documentation;

11) are recorded violations of safety requirements of flights and aviation events.

35. Instructions of service employees of security service of flights for the questions carried to their competence are accepted to execution by all service employees of relevant organs of management, air units and parts of providing the state aircraft.

Chapter 4. The organization of scheduled maintenance on prevention of aviation incidents and activities for safety management of flights in the state aircraft

Paragraph 1. Content, essence, principles and organization of scheduled maintenance on prevention of aviation incidents and activities for safety management of flights

36. Scheduled maintenance on prevention of aviation incidents and activities for safety management of flights constitutes the main content of activities of specialists of security service of flights and is carried out in all controls, air units and parts of providing.

37. The essence of activities for safety management of flights consists in active identification of dangerous factors of aviation activities, assessment of risk level and taking measures to reduction of risk level by elimination of dangerous factors, decrease in their influence or evasion from them.

The essence of scheduled maintenance on prevention of aviation incidents consists in holding the actions directed to exception of repeatability of aviation incidents on the famous groups of factors reasons.

38. The basic principles determining effectiveness of work on prevention of aviation incidents are:

1) objectivity in case of identification and the analysis of dangerous factors;

2) timeliness and periodic repeating of actions for prevention of aviation incidents;

3) enhancement of methods, methods and principles of operation on prevention of aviation incidents;

4) systematicity, complete scope of aviation activities, completeness of the taken measures;

5) personal participation and personal example of administrative board in carrying out work on prevention of aviation incidents, in observance of established procedure and rules of flights;

6) permanent efficiency evaluation of the carried-out work.

Paragraph 5.

The name of paragraph 5 is excluded according to the Order of the Minister of Defence of the Republic of Kazakhstan of 06.08.2020 No. 371

39. The organization of activities of specialists of security service of flights includes:

1) safety management of flights;

2) work planning on prevention of aviation incidents;

3) the main preventive actions on prevention of aviation incidents;

4) analysis and efficiency evaluation of work on prevention of aviation incidents and activities for safety management of flights.

Paragraph 3. Safety management of flights

40. The safety management system of flights will be organized in air units and controls of the state aircraft.

40-1. In security service of flights of the state aircraft control of scheduled maintenance on prevention of aviation incidents and activities for safety management of flights in subjects of the state aircraft is exercised.

41. The safety management process of flights includes:

1) identification of dangerous factors;

2) analysis of dangerous factors and assessment of risk level;

3) the prevention of service employees, representatives to make the decision, on risk factor with offers on reduction of admissible risk or prevention of unacceptable risk;

4) decision making by service employees on implementation of the offers specified in the warning of risk factor;

5) control of implementation of offers according to the warning of risk factor;

6) repeated assessment of the situation.

Paragraph 4. Identification of dangerous factors

42. All service employees participating in the organization, management, accomplishment and flight servicing, and also controlling their carrying out are engaged in identification of dangerous factors.

43. Control of activities for identification of dangerous factors is exercised by the senior aviation chiefs.

44. For identification of dangerous factors observations and the reports of the service employees who are organizing, carrying out, providing and servicing flights, materials of means of objective control, the message of the service employees controlling flights, entries in magazines of the flight operations director and the senior engineer of flights, onboard and technical documentation, attestations of eyewitnesses and voluntary messages of persons having data on violations are used.

45. Main forms of work on identification of dangerous factors:

1) the analysis of the represented data on condition of aviation system and activities of aeronautical personnel;

2) forecasting of dangerous factors;

3) inspection (check) of structural divisions;

4) investigation of aviation incidents and incidents;

5) voluntary (confidential) messages on the shortcomings, special situations menacing to aviation safety.

46. The system of data presentation about condition of aviation system and activities of aeronautical personnel will be organized by heads of security service of flights, with frequency, amount and contents of information, the dangerous factors providing timely identification.

47. In air units (parts of providing) forecasting of dangerous factors is applied in the simplified type by job analysis by administrative board and anticipation of conditions in which the tasks set the forthcoming academic year are solved.

48. Treat the tasks set the forthcoming academic year:

1) training on other types of air vehicles;

2) development of new policy strokes;

3) development of new systems of servicing of aviation engineering.

49. In controls of the state aircraft forecasting of dangerous factors is applied in the simplified type by job analysis of separate elements and aviation system in general.
