According to the paragraph to the seventeenth article 4 of the Law of Ukraine "About traffic", the Cabinet of Ministers of Ukraine decides:

1. Approve enclosed:

Procedure for functioning of system of fixing of administrative offenses in the field of safety control of traffic in automatic mode;

Procedure for the address of person which allowed administrative offense in the field of traffic safety control in authorized division of National police.

2. To the Ministry of Internal Affairs in two-month time to approve in coordination with Administration of Public service of special communication and information security Technical requirements to system of fixing of administrative offenses in the field of safety control of traffic in automatic mode.

3. To the Ministry of Internal Affairs together with the Ministry of infrastructure to approve in coordination with Administration of Public service of special communication and information security of procedure for mutual exchange of information about rather:

the issued decrees on imposing of administrative punishment for the offenses in the field of traffic safety control fixed in automatic mode;

delivery/not delivery or refusal of receipt of the registered mail with resolutions on imposing of administrative punishment for the offenses in the field of traffic safety control fixed in automatic mode, the persons in charge specified in part one of article 14-2 of the Code of Ukraine about administrative offenses, resident persons of Ukraine who imported the vehicles registered outside Ukraine or persons who actually managed vehicles at the time of making of the specified offenses;

persons who imported on the territory of Ukraine the vehicles registered abroad and also about delivery to foreigners and stateless persons when crossing by them of frontier of Ukraine of copies of resolutions on imposing of administrative punishment for the offenses in the field of traffic safety control fixed in automatic mode.

heads of legal entities behind whom vehicles on which the offenses in the field of traffic safety control fixed in automatic mode and also persons performing powers of heads of such legal entities are made are registered.

4. To provide to the ministries, other central executive bodies within three months adoption of regulatory legal acts for realization of provisions of this resolution and reduction of own regulatory legal acts in compliance with this resolution.

5. This resolution becomes effective from the date of its publication.

Procedure for functioning of system of fixing of administrative offenses in the field of safety control of traffic in automatic mode

General provisions

1. This Procedure determines operational requirements of system of fixing of administrative offenses in the field of safety control of traffic in automatic mode.

2. The terms used in this Procedure have the following value:

technical means (monitoring instruments) are the devices allowing to perform in automatic mode identification and photographing or video of the events containing signs of administrative offenses in the field of traffic safety control and in which information is protected according to the legislation on information security in information and communication systems;

metadata - the structured data which contain the data on event fixed by means of technical means (monitoring instruments), the characteristic of the fixed vehicle necessary for its identification, parameters of functioning of technical means (monitoring instruments), and also other data necessary for accounting, search, assessment and management of such data;

the information file - the arranged set determined by the legislation in the field of technical regulation and standardization of actual data with results of fixing (pictures or videos) technical means (monitoring instruments) of the event containing signs of administrative offense in the field of traffic safety control, and metadata to them, created by the specified technical means (monitoring instruments) and protected with use of the qualified digital signature;

system of fixing of administrative offenses in the field of safety control of traffic in automatic mode (further - system) - the interconnected set of technical means (monitoring instruments), program and hardware of processing of the information files and metadata, exchange with use of electronic communication networks of information necessary for the realization of organizational and procedural measures in case of control of observance of Traffic regulations by his participants functioning in unified information system of the Ministry of Internal Affairs received by means of technical means (monitoring instruments) (further - unified information system).
