1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in electronic form and paper, in the Russian and Kazakh languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan.

3. To impose control of execution of this order on the vice-chairman of Committee of homeland security of the Republic of Kazakhstan - Directors of the Border service.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of compensation to the state of the money spent for training of the military personnel in military, special educational institutions of bodies of homeland security of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of compensation to the state of the money spent for training of the military personnel in military, special educational institutions of bodies of homeland security of the Republic of Kazakhstan (further – Rules), determine procedure for compensation to the state of the money spent for training of the military personnel in military, special educational institutions of bodies of homeland security of the Republic of Kazakhstan (further – ONB) in the organizations of the higher and (or) postgraduate education of the Republic of Kazakhstan or foreign states.

2. Compensation to the state of the money spent for training of the military personnel in the military, special ONB educational institutions is performed according to Items 12 and 13 of article 10 of the Law of the Republic of Kazakhstan "About special state bodies of the Republic of Kazakhstan" and Item 10 of article 26 of the Law of the Republic of Kazakhstan "About military service and the status of the military personnel".

3. Personnel divisions of departments, structural divisions, territorial and other authorities of Committee of homeland security on the last duty station (training) of the serviceman inform Personnel department of Committee of homeland security of the Republic of Kazakhstan (personnel division of the Border service of Committee of homeland security of the Republic of Kazakhstan):

1) about expel of the serviceman from the organizations of the higher and (or) postgraduate education of the Republic of Kazakhstan and foreign states for poor progress, indiscipline, on the initiative, as a result of dismissal from military service for negative motives – within five working days from the date of the publication of the order;

2) about refusal of the serviceman to sign the contract on passing of military service, dismissal of the serviceman who graduated from military educational institution from military service for negative motives before the expiration of the terms provided by subitems 5) and 6) of Item 1 of article 40 of the Law of the Republic of Kazakhstan "About military service and the status of the military personnel" – within five working days from the date of documentary confirmation of refusal.

4. For carrying out claim work on collection from the serviceman of the money spent for training, personnel division of ONB in the last duty station (training) of the dismissed (deducted) serviceman directs to legal division of ONB on the last duty station (training) of the serviceman the following materials:

1) the contract on passing of military service in form according to the Standard form approved by the order of the Minister of Defence of the Republic of Kazakhstan of January 29, 2018 No. 36/chipboard "About Approval of Standard Forms of the Contract on Passing of Military Service and Representation, and also Forms of the Appraisal Sheet" (it is registered in the Register of state registration of regulatory legal acts for No. 16594);

2) the statement from the order of the chief of the organization of the higher and (or) postgraduate education on transfer and exception of lists of military educational institution – concerning the deducted (dismissed) serviceman;

3) the statement from the order on exception of ONB – concerning the serviceman who graduated from the organization of the higher and (or) postgraduate education;

4) summary calculation of actual costs on training of the serviceman (the cadet, the undergraduate, the doctoral candidate) in the organization of the higher and (or) postgraduate education for form according to appendices 1, 2 to these rules;

5) summary calculation of actual costs on training of the serviceman (the cadet, the graduated in a military academy) in the organizations of the higher and (or) postgraduate education of foreign state for form according to appendices 3, 4 to these rules.

The serviceman deducted from the organization of the higher and (or) postgraduate education for poor progress, indiscipline, on the initiative, as a result of dismissal from military service for negative motives, in connection with the termination of nationality of the Republic of Kazakhstan, and also the contract on passing of military service which refused to sign compensates to the state the money corresponding to costs for providing with food, payment of official pay rate (grant) and journey of the cadet to the organizations of the higher and (or) postgraduate education during their training in the organizations of the higher and (or) postgraduate education in the status of the serviceman, except for costs of the first year of training in the status of the serviceman.
