According to article 5-2 of the Law of the Republic of Kazakhstan "About power industry" and with Item 3 of article 8 of the Law of the Republic of Kazakhstan "About heat-and-power engineeering" PRIKAZYVAYU:

1. Approve the enclosed Rules of subsidizing of costs of the power making organizations and the heatmaking subjects on acquisition of fuel for uninterrupted carrying out heating season and losses (debts) the power making organizations, hundred percent of shares (share in the authorized capital) which belong to the state, being in utility property and performing at the same time activities for production of water (distillate), electrical and heat energy.

2. To provide to department of power industry and coal industry of the Department of Energy of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of subsidizing of costs of the power making organizations and the heatmaking subjects on acquisition of fuel for uninterrupted carrying out heating season and losses (debts) the power making organizations, hundred percent of shares (share in the authorized capital) which belong to the state, being in utility property and performing at the same time activities for production of water (distillate), electrical and heat energy (further – the power making organizations being in utility property) (further – Rules) is developed according to article 5-2 of the Law of the Republic of Kazakhstan "About power industry" and with Item 3 of article 8 of the Law of the Republic of Kazakhstan "About heat-and-power engineeering" and determines procedure for subsidizing of costs of the power making organizations and the heatmaking subjects on acquisition of fuel for uninterrupted carrying out heating season and losses (debts) the power making organizations, being in utility property.

2. Subsidizing of costs of the power making organizations and the heatmaking subjects on acquisition of fuel for uninterrupted carrying out heating season and losses (debts) the power making organizations which are in utility property is performed by local executive bodies of areas, the cities of republican value, the capital (further – local executive bodies) at the expense of the means provided in the local budget.

3. Subsidies for acquisition of fuel are provided to the power making organizations and the heatmaking subjects for uninterrupted carrying out heating season.

Subsidies for repayment of losses (debts) are provided to the power making organizations, hundred percent of shares (share in the authorized capital) which belong to the state, being in utility property and performing at the same time activities for production of water (distillate), electrical and heat energy (further – the power making organizations being in utility property).

Chapter 2. Procedure for subsidizing of costs of the power making organizations and the heatmaking subjects on acquisition of fuel for uninterrupted carrying out heating season

4. Local executive bodies establish start and end date of order taking of the power making organizations and the heatmaking subjects on acquisition of fuel for uninterrupted carrying out heating season taking into account climatic conditions.

5. The power making organizations and the heatmaking subjects provide in the relevant local executive body the request for receipt of subsidy for acquisition of fuel in any form (further – the request).

2) data on lack (availability) of tax debt; receiver of subsidy for the application moment;

3) bank details;
