About social services

This Law determines the main organizational and legal basis of rendering social services to the persons which are in difficult vital circumstances and needing assistance.

Section I General provisions

Article 1. Determination of the main terms

In this Law terms are used in the following value:

social services - complex of actions for assistance to persons, separate social groups which are in difficult vital circumstances and cannot independently overcome them, for the purpose of the solution of their vital problems;

difficult vital circumstances - the circumstances caused by disability, age, the state of health, social position, vital habits and method of life as a result of which person in parts or in full has no (did not acquire or lost) capability or opportunity to care independently for private (family) life and to take part in public life);

the social worker - professionally trained professional having necessary qualification in the sphere of social work and rendering social services;

social servicing - the system of social measures providing assistance, support and services rendered by social services to individuals or national groups for overcoming or mitigation of vital difficulties, maintenance of their social status and full activity;

social services - the companies, organizations and the organizations irrespective of patterns of ownership and managing, and also the citizens rendering social services to the persons which are in difficult vital circumstances and needing assistance;

the paragraph of the seventh is excluded;

temporary shelter for adults - the organization of night or temporary residence of homeless people, persons which were affected by physical or mental abuse, domestic violence and human trafficking, natural disaster, catastrophic crash, etc. with rendering the legal, psychological, public, medical and household assistance to them in overcoming temporary difficulties, assistance in identification, recovery of documents, certification and employment;

temporary shelter for minors - the organization of temporary residence, education, content of street children, the children deprived of parent care who experienced cruelty violence, domestic violence and suffered from trade in children or for other reasons need social protection;

the paragraph the tenth is excluded;

the subjects providing social services - the companies, organizations, the organizations and institutions, irrespective of pattern of ownership and housekeeping, physical persons - the entrepreneurs corresponding to criteria of activities of the subjects providing social services, and also the physical persons providing social services.

the social worker - person providing social services also has preparation which meets the requirements and nature of the performed work;

social group - group of persons, united on general social, demographic or other feature which are in difficult vital circumstances and need provision of the same social services by it;

state standard of social service - the contents and amount determined by the normative legal act of the central executive body in the sphere of social policy, regulations and standard rates, conditions and procedure for provision of social service, indicators of its quality;

indicators of quality of social services - set of indicators which are used for assessment of activities of the subjects providing social services which are based on positive effectiveness of social services concerning her receivers and degree of satisfaction of their need for these services;

the social order - means of regulation of activities in the sphere of provision of social services by attraction on contractual basis of subjects of managing for requirements satisfaction in the social services determined by local executive bodies and local government bodies.

Article 2. Main beginnings of rendering social services

The main beginnings of rendering social services are:

assistance to persons which are in difficult vital circumstances which they are not able to overcome by means of the available means and opportunities;

prevention of emergence of difficult vital circumstances;

creation of conditions for the independent solution of the arising vital problems.

Article 3. Basic principles of rendering social services

Rendering social services is based on the principles:

targeting and individual approach;

availability and openness;

voluntariness of the choice of obtaining or refusal of rendering social services;

humanities;

complexity;

maximum efficiency of use of budgetary and extrabudgetary funds by subjects who render social services;

legality;

social justice;

ensuring confidentiality with the subjects providing social services;

observance by the subjects providing social services, state standards of social services, ethical standards and rules.

Article 4. Legislation on social services

The legislation of Ukraine on social services is based on the Constitution of Ukraine and consists of this Law, other regulatory legal acts and international treaties of Ukraine.

If international treaties of Ukraine establish higher requirements to rendering social services, than those that are stipulated by the legislation Ukraine, rules of the international treaty are applied.

Article 5. Types of social services and form of their rendering

The main forms of rendering social services are financial support and social servicing.

Financial support is provided to persons which are in difficult life situation in the form of cash or natural benefit: food, means of sanitation and personal hygiene, conditioning agents for children, clothes, footwear and other necessities, fuel, and also technical and supportive applications of rehabilitation.

Social servicing is performed:

at the place of residence of person (house);

at the place of residence (stay) of the child in families of citizens which according to the agreement provide services in content and education of the child (foster homes, orphanages of family type, family of foster tutors);

in stationary residential care facilities and institutions;

in rehabilitation organizations and institutions;

in organizations and institutions of day stay;

in organizations and institutions of temporary or permanent stay;

in the territorial centers of provision of social services;

in other institutions of social support (supervision).
