Rules of calculation of the length of service of government employees granting the right to establishment of official pay rate

1. These rules of calculation of the length of service of government employees granting the right to establishment of official pay rate (further - Rules), are developed according to Item 6 of article 53 of the Law of the Republic of Kazakhstan of November 23, 2015 "About public service of the Republic of Kazakhstan" and determine procedure for calculation of the length of service of government employees granting the right to establishment of official pay rate.

2. The years of service granting the right to establishment of official pay rate according to the coefficients for calculation of official pay rates and benefits for improvement of government employees established based on single system of compensation of employees of the bodies of the Republic of Kazakhstan containing at the expense of the government budget, the Republic of Kazakhstan approved by the Government in coordination with the President of the Republic of Kazakhstan join all the time of stay in public service which is estimated from the moment of appointment or election to the state position before the termination of public service according to the procedure, established by the legislation of the Republic of Kazakhstan in the sphere of public service.

3. For calculation of the length of service granting the right to establishment of official pay rate time also joins:

4) works on judgeship and the state (responsible) positions in offices (offices) of courts of the Republic of Kazakhstan and the former USSR;

5) leaves non-paid on child care before achievement of age of three years, and also other types of social leaves by it non-paid to persons who are in public service;

6) works serving in National Bank of the Republic of Kazakhstan and its branches, and also system of National bank of the former USSR;

7) works on elective and other responsible offices in party, trade-union and Komsomol bodies of the Kazakh Soviet Socialist Republic and the Republic of Kazakhstan till January 1, 1992;

8) works in public institutions and the state companies on the executive positions or positions corresponding to the functional directions of specific managerial state position;

8-1) works in subjects of the quasi-public sector and/or big business on the executive positions or positions corresponding to the functional directions of the held state position for political government employees, administrative government employees of the case "A", and also case "B" of categories A-1, A-2, B-1, B-2, C-1, C-2, C-O-1, C-O-2, C-R-1, C-R-2, D-1, D-2, D-O-1, D-O-2, E-1, E-2, E-R-1;

11) works in the Eurasian economic commission and Court of the Eurasian Economic Union;

15) from the moment of wrongful dismissal of government employees before their recovery in public service;

4. To law enforcement officers the years of service granting the right to establishment of official pay rate join service time in law enforcement agencies and military service in Armed Forces, other troops and military forming of the State Parties of the Commonwealth of Independent States.

5. The years of service granting the right to establishment of official pay rate are determined by the commission on establishment of working life which structure affirms the authorized person having the right of appointment to positions and releases from positions of employees of state body.

The bases for consideration of question of establishment of the years of service granting the right to establishment of official pay rate are:

1) statement of the government employee;

2) appointment of the government employee to the state position in state body.
