About approval of the Instruction about procedure for financing of payment process by agent banks of the guaranteed compensation amount on deposits and recognition No. 2697 which voided decisions of executive directorate of Fund of guaranteeing household deposits of December 5, 2016

According to Item 10 parts one and parts six of article 12 of the Law of Ukraine "About system of guaranteeing household deposits" executive directorate of Fund of guaranteeing household deposits of RESHILA:

1. Approve the Instruction about procedure for financing of payment process by agent banks of the guaranteed compensation amount on deposits which is applied.

2. Declare invalid the decision of executive directorate of Fund of guaranteeing household deposits of December 5, 2016 No. 2697 "About approval of the Procedure for financing of payment process by agent banks of the guaranteed compensation amount on deposits within pilot project on implementation of the Automated payment system of Fund of guaranteeing household deposits", registered in the Ministry of Justice of Ukraine on December 28, 2016 at No. 1717/29847.

3. To provide to department of strategy and normative and methodological providing together with legal department submission of this decision to the Ministry of Justice of Ukraine for state registration.

4. To provide to department of public relations and financial education placement of this decision on the official page of Fund of guaranteeing household deposits on the Internet after its state registration.

5. This decision becomes effective from the date of, its official publication following behind day.

6. Control over the implementation of this decision to leave for the managing director.

The instruction about procedure for financing of payment process by agent banks of the guaranteed compensation amount on deposits

1. This Instruction which, is developed according to the Law of Ukraine "About system of guaranteeing household deposits" (further - the Law) establishes the procedure of making of actions by Fund of guaranteeing household deposits (further - Fund) about financing of payment process by agent banks of the guaranteed compensation amount on deposits to investors of banks which are removed from the market or are liquidated based on part two of article 77 of the Law of Ukraine "About banks and banking activity" (further - insolvent banks), and also the means paid by Fund on execution in voluntary procedure for judgments for benefit of investors on collection of the guaranteed compensation amount on the contribution placed in bank to which investors it is stopped or complete payments, and/or other amounts connected with such collection.

2. In this Instruction the term "payments" is used as payment by agent bank:

the guaranteed compensation amount on deposits to investors of insolvent banks;

the means paid by Fund on execution in voluntary procedure for judgments for benefit of investors on collection of the guaranteed compensation amount on the contribution placed in bank to which investors it is stopped or complete payments, and/or other amounts connected with such collection.

3. The fund performs financing of payment process by agent banks on certain models of financing and in forms of preliminary financing, current financing, and also additional preliminary financing.

4. The fund determines such models of financing of payment process by agent banks:

1) model of financing "And" (advancing) which provides that the Fund twice a day (except output, festive and non-working days) determines the need for financing of agent banks and advances payments, proceeding from certain requirement;

2) financing model "In" (compensations) which provides that the agent bank performs payments at the expense of own means and the Fund twice a day (except output, festive and non-working days) performs compensation to agent bank of the means spent by it.

5. Models of financing of payment process are determined in the following procedure:

the list of agent banks in the descending procedure for amounts of the payments made by them for the last month is constituted (further - the list);

in the list the first part consisting of the first agent banks to which payments which totally reach 70 percent of total amount of payments are performed is allocated;

for agent banks which contain in the first part of the list and are carried to the I group of agent banks according to the Regulations on procedure for determination of agent banks of Fund of guaranteeing household deposits approved by the decision of executive directorate of Fund of guaranteeing household deposits of July 12, 2012 No. 6, registered in the Ministry of Justice of Ukraine on September 4, 2012 at No. 1494/21806 (with changes), the model of financing "And", and for other agent banks - financing model is determined "In".

The example of determination of models of financing of payment process by agent banks is given in appendix to this Instruction.

6. Initial financing of payment process by Fund by agent banks is performed by Fund in its working day from 9 to 11 o'clock and provides:

1) transfer to agent bank for which the model of financing "And", the amount of means calculated by formula is determined:
