About approval of the Procedure for creation and maintaining NKREKP of the register of subjects of natural monopolies

According to the laws of Ukraine "About the National commission performing state regulation in the field of power and utilities" "About state regulation in the field of utilities" the National commission performing state regulation in spheres of power and utilities decides:

1. Approve the Procedure for creation and maintaining by the National commission performing state regulation in spheres of power and utilities, the register of subjects of natural monopolies which is applied.

2. Declare invalid the resolution of the National commission performing state regulation in spheres of power and utilities, of March 19, 2015 No. 826 "About approval of the Procedure for creation and maintaining NKREKP of the register of subjects of natural monopolies", registered in the Ministry of Justice of Ukraine on April 3, 2015 at No. 372/26817 (with changes).

3. This resolution becomes effective from the date of, its publication following behind day in the official printing publication - the Pravitelstvenny Kuryer newspaper.

Procedure for creation and maintaining by the National commission performing state regulation in spheres of power and utilities, the register of subjects of natural monopolies

1. The national commission performing state regulation in spheres of power and utilities constitutes and keeps the register of subjects of the natural monopolies performing economic activity in spheres of power and utilities which form is given in appendix 1 to this Procedure (further - the Register).

The register is constituted and kept concerning subjects of managing which according to the Law of Ukraine "About natural monopolies" perform activities on:

1) to oil transportation and oil products on pipelines;

2) to transportation of natural and oil gas by pipelines;

3) to distribution of natural and oil gas pipelines;

4) to storage of natural gas in the amounts exceeding the level which is established by conditions and rules of implementation of business activity on storage of natural gas (licensed conditions);

5) to transfer of electrical energy;

6) to distribution of electrical energy (transfer of electrical energy local (local) power supply networks);

7) to centralized water supply and water disposal;

8) transportation of heat energy;

9) to ammonia transportation by bulk distribution lines.

2. The information about subjects of the natural monopolies which obtained licenses for the right of implementation of economic activity in the spheres determined in subitems 1 - the 8th Item of 1 this Procedure which state regulation of activities is performed by NKREKP, regional, Kiev city public administrations or which establishes rate for ammonia transportation by bulk distribution lines is entered in the Register.

3. Entering into the Register of information about subjects of the natural monopolies performing economic activity in spheres of centralized water supply and water disposal, transportation of heat energy according to the licenses granted regional, Kiev city by public administrations is performed based on information provided in NKREKP regional Kiev city by public administrations in the form given in appendix 2 to this Procedure no later than the 5th day of every month.

4. The information about subjects of the natural monopolies performing economic activity in spheres of power and utilities is entered by NKREKP in the Register as of the last number of month under report.

5. The register is posted monthly no later than the 7th on the official site of NKREKP (http://www.nerc.gov.ua/) from which data monthly to the 10th on electronic and papers are represented to the Antimonopoly Committee of Ukraine.
