1. Approve the enclosed Rules of forming and maintaining the register of domestic producers and domestic suppliers of works, services.

2. To provide to development department of defense industry complex of the Ministry of the defense and aerospace industry of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of the defense and aerospace industry of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of the defense and aerospace industry of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.

3. To impose control of execution of this order on the supervising vice-minister of the defense and aerospace industry of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming and maintaining register of domestic producers and domestic suppliers of works, services

Chapter 1. General provisions

1. These rules of forming and maintaining the register of domestic producers and domestic suppliers of works, services (further – Rules) are developed according to subitem 3-1) of Item 2 of article 7 of the Law of the Republic of Kazakhstan of January 19, 2001 "About the state defensive order" (further – the Law) and determine procedure for forming and maintaining the register of domestic manufacturers of goods of military (products), goods (products) of dual purpose (application) (further – domestic producer) and domestic suppliers of military works and military services (further – the domestic supplier of works, services).

2. The register of domestic producers and domestic suppliers of works, services (further – the Register) contains data on domestic producers and domestic suppliers of the works and services making goods (products) and supplying works and services for the state customers which are part of the state defensive order.

3. The register is created and kept for the purpose of implementation of the choice of contractors of the state defensive order according to the legislation on the state defensive order.

Chapter 2. Procedure for forming and maintaining register of domestic producers and domestic suppliers of works, services

4. Forming and maintaining the Register is performed by the operators on execution of the state defensive order determined by the Government of the Republic of Kazakhstan (further – operators).

5. The register is kept in form, according to appendix 1 to these rules.

6. The domestic producers and domestic suppliers of works, services who are residents of the Republic of Kazakhstan and provided complete document package, stipulated in Item 10 these rules are subject to inclusion in the Register.

7. The domestic producers and domestic suppliers of works, services included in the Register of unfair participants of public procurements are not subject to inclusion in the Register.

8. Forming and maintaining the Register is performed by inclusion in the Register and exceptions of it of domestic producers and domestic suppliers of works, services, and also modification and amendments in the information about them containing in the Register according to statements of operators based on the decision of authorized body.

9. Forming and maintaining the Register is performed by operators on activities based on the submitted applications about inclusion in the Register of domestic producers and domestic suppliers of works, services (further - the Request) from domestic producers and domestic suppliers of works, services in form, according to appendix 2 to these rules, signed by the first head of the legal entity.

10. Applications are submitted by domestic producers and domestic suppliers of works, services addressed to operators in the corresponding direction.

Order taking is performed till March 1 and till September 1 of the current year respectively.

The following documents are attached to the request:

1) the copy of constituent documents with obligatory presentation of the original for reconciliation or notarially attested copy of constituent documents;

2) the copy of the certificate on the state (accounting) registration (re-registration) of the legal entity (branch, representation) or the copy of the certificate of the state (accounting) registration, with indication of business and identification number;

3) the document witnessing lack of tax debt, debt on compulsory pension contributions and social assignments;

4) the document witnessing solvency (own, borrowed funds);
