1. Approve the enclosed Rules of expel from military educational institutions of the Ministry of Defence of the Republic of Kazakhstan.

2. To provide to Department of Education and Science of the Ministry of Defence of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Defence of the Republic of Kazakhstan after its first official publication;

4) the direction of data in Legal department of the Ministry of Defence of the Republic of Kazakhstan on execution of the actions provided by subitems 1), 2) and 3) of this Item within ten calendar days from the date of state registration.

Chapter 1. General provisions

1. These rules of expel from military educational institutions of the Ministry of Defence of the Republic of Kazakhstan (further - Rules) are developed according to the laws of the Republic of Kazakhstan "About defense and Armed Forces of the Republic of Kazakhstan", "About military service and the status of the military personnel" and determine procedure for expel from military educational institutions of the Ministry of Defence of the Republic of Kazakhstan (further - HIGHER EDUCATION INSTITUTION).

Expel of the military personnel of state members of the Collective Security Treaty Organization (further - the CSTO) from HIGHER EDUCATION INSTITUTIONS is made in accordance with the terms of the contracts signed between the Ministry of Defence of the Republic of Kazakhstan and the Ministries of Defence of state members of the CSTO.

3. Expel of students from HIGHER EDUCATION INSTITUTION is made on the following bases:

1) on poor progress;

2) on personal initiative of the student;

3) on indiscipline;

4) in connection with dismissal from military service for negative motives according to the subitem 11) Item 1 of article 26 of the Law of the Republic of Kazakhstan "About military service and the status of the military personnel" (further - the Law);

5) in connection with dismissal from military service for health reasons;

6) deprivation of the admission to the data constituting the state secrets;

7. Expel from HIGHER EDUCATION INSTITUTION on poor progress is carried out according to the official report of the head of department of quality evaluation of education (monitoring).

The official report moves on the chief of HIGHER EDUCATION INSTITUTION within three working days from the moment of approach any of the reasons specified in Item 8 of these rules.

8. To expel from HIGHER EDUCATION INSTITUTION on poor progress students are represented:

1) the carrying out the current control of progress, intermediate and final assessment of students having the academic debt and not liquidating it prior to the beginning of the new academic period, except as specified, of stipulated in Item 23 Rules in the HIGHER EDUCATION INSTITUTIONS subordinated to the Ministry of Defence of the Republic of Kazakhstan approved by the order of the Minister of Defence of the Republic of Kazakhstan of January 22, 2016 No. 32 (it is registered in the Register of state registration of regulatory legal acts at No. 13264);
