About approval of samples of the professional diploma, confirmation of the professional diploma, Rules of certification of seamen

According to subitem 55-3) of Item 3 of article 4 of the Law of the Republic of Kazakhstan of January 17, 2002 "About merchant shipping" and the subitem 4) Item 1 of article 12 of the Law of the Republic of Kazakhstan of May 16, 2014 "About permissions and notifications" PRIKAZYVAYU:

1. Approve:

1) sample of the professional diploma according to appendix 1 to this order;

2) model of confirmation of the professional diploma according to appendix 2 to this order;

3) Rules of certification of seamen according to appendix 3 to this order.

2. Declare invalid the order of the Minister of investments and development of the Republic of Kazakhstan of March 31, 2015 No. 421 "About approval of samples of the professional diploma, confirmation of the professional diploma, Rules of issue, suspension of effective period, withdrawal of the professional diploma, confirmation of the professional diploma, preferential permission, and also the qualification requirements imposed to crew members of the vessel" (registered in the Register of state registration of regulatory legal acts for No. 12283, published on November 20, 2015 in information system of law of Ad_let).

3. To provide to committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.

4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

5. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of certification of seamen

Chapter 1. General provisions

1. These rules of certification of seamen (further - Rules) are developed according to subitem 55-3) of Item 3 of article 4 of the Law of the Republic of Kazakhstan of January 17, 2002 "About merchant shipping" and the International convention about preparation and certification of seamen and execution of watch, 1978, with amendments (further - PDNV) and determine procedure for certification of seamen.

2. Rules are applied to the citizens of the Republic of Kazakhstan, foreign citizens and stateless persons working or applying to work at ocean ships for the purpose of merchant shipping, except crew members of vessels of navy, fishing boats, the pleasure yachts which are not used for commercial purposes and wooden vessels of primitive construction.

3. The concepts used in these rules:

1) the senior mechanic - the senior on position of mechanics, responsible for the propulsion system, and also operation and maintenance of mechanical and electrical units on the vessel;

2) face of command structure - the crew member of command position who is not the captain;

3) face of ordinary structure - the crew member of the vessel who is not the captain or face of command structure;

4) the second mechanic - the mechanic following on position after the senior mechanic responsible for the propulsion system, and also operation and maintenance of mechanical and electrical units on the vessel in case of inability of the senior mechanic to bear such responsibility;

5) the senior assistant of the captain - person of command structure following on position after the captain to who command of the vessel in case of inability of the captain to order the vessel is assigned;

6) the captain - person ordering the vessel;

7) the professional diploma - the diploma issued to the crew member of the vessel and confirming its qualification;

8) confirmation of the professional diploma - the document certifying recognition of the foreign professional diploma or issue of the professional diploma (except for diplomas of faces of ordinary structure);

9) preferential permission - the document based on which the crew member of the vessel is allowed to holding the post on which has no corresponding professional diploma, for the term of no more than 6 months;

10) the radioman - person having the proper diploma issued or recognized based on the Regulations of radio communication accepted in 1995 at the World conference of radio communication by the International Telecommunications Union (further - Regulations of radio communication);

11) Sea port administration - territorial subdivision of department of authorized body;

12) the electrician - person of command structure having qualification according to the Rule III/6 PDNV;

13) authorized body - the central executive body performing management in the field of merchant shipping and also in limits, stipulated by the legislation the Republic of Kazakhstan, - cross-industry coordination;

14) the certificate of training of the specialist of sea transport - the document which is not the professional diploma, issued to the seaman and confirming fulfillment of requirements of PDNV;

15) the seaman - the crew member of the ocean ship.

4. The professional diploma, confirmation of the professional diploma, preferential permission are issued by Sea port administration in the state and English languages.

5. The professional diploma, confirmation of the professional diploma, preferential permission are issued to persons not more young than 18 years.

6. Effective period of the professional diploma for persons specified in Item 8 of these rules constitutes 5 years.

Confirmation of the professional diploma loses force after effective period of the professional diploma and is invalid without professional diploma.

The professional diploma for ordinary structure is termless.

The swimming years of service for receipt of primary professional diploma of the captain or face of command structure are acquired in courts of gross tonnage or with the main propulsion system capacity, specified in this professional diploma.

7. The position in which the owner of the professional diploma is allowed to work is specified in terms, identical subjects which are used in requirements of the minimum structure of crew of the vessel according to PDNV.

8. Professional diplomas and confirmations of professional diplomas are issued to following members of crew of the vessel:

1) log assistant to the ship master of the gross tonnage of 500 register tons or more;

2) senior assistant of the ship master of gross tonnage from 500 to 3000 register tons;

3) senior assistant of the ship master of the gross tonnage of 3000 register tons or more;

4) ship master of gross tonnage from 500 to 3000 register tons;

5) ship master of the gross tonnage of 3000 register tons or more;

6) log assistant to the ship master of coastal swimming of gross tonnage less than 500 register tons;

7) ship master of coastal swimming of gross tonnage less than 500 register tons;

8) the log mechanic of the vessel with the main propulsion system capacity of 750 kW or more;

9) the second mechanic of the vessel with the main propulsion system capacity from 750 to 3000 kW;

10) the second mechanic of the vessel with the main propulsion system capacity of 3000 kW or more;
