About fight against terrorism
The purpose of this Law is regulation of the relations in the field of fight against terrorism.
The main objectives of this Law are safety of the personality, society and state from terrorism, protection of sovereignty and territorial integrity of the state, preserving the civil world and national consent.
In this Law the following basic concepts are applied:
the hostage - the physical person captured or withheld by terrorists for the purpose of compulsion of state governing bodies, international organizations, and also individuals to make or refrain from making of any action as conditions of release of the captured or withheld person;
terrorism - the violence, threat of its application or other criminal actions creating danger of life, to health of the personality, destruction (damage) of property and other material objects and the states directed to compulsion of the international organization, physical person or legal entity to make or refrain from making of any actions, complication of the international relations, violation of sovereignty, territorial integrity, undermining safety of the state, provocation of armed conflicts, intimidation of the population, destabilization of social and political situation, for achievement of political, religious, ideological and other goals, responsibility for which is provided by the Criminal code of the Republic of Uzbekistan;
terrorism financing - the activities aimed at providing existence, functioning, financing of the terrorist organization, trip abroad or movement through the territory of the Republic of Uzbekistan for participation in terrorist activities, preparation and making of act of terrorism, direct or indirect provision or collection of any means, resources, other services to the terrorist organizations or persons helping or participating in terrorist activities;
the terrorist - the person who is participating in implementation of terrorist activities, and also performed trip abroad or movement through the territory of the Republic of Uzbekistan for participation in terrorist activities;
terrorist group - the group of persons which by previous concert committed act of terrorism, preparation for act of terrorism or attempt at its making;
the terrorist organization - steady consolidation of two or more persons or terrorist groups for implementation of terrorist activities;
anti-terrorist operation - complex of the approved and interconnected special events directed to suppression of act of terrorism and minimization of its effects, and also safety of physical persons and neutralization of terrorists;
the anti-terrorist operation zone - certain sites of the area or the water area, airspace, vehicles, buildings, structures, constructions, rooms and the territories adjoining to them within which anti-terrorist operation is performed;
terrorist activities - the activities including the organization, planning, preparation and implementation of act of terrorism, instigation to act of terrorism, creation of the terrorist organization, recruitment, preparation and arms of terrorists, their financing and material logistics;
act of terrorism - crime execution of terrorist nature in the form of capture or deduction of hostages, infringement of life of the state or public figure, representatives of the national, ethnic, religious, other national groups, foreign states and the international organizations, capture, damage, destruction of objects of the state or social significance including stationary platforms located on the continental shelf, explosion, arson, application or threat of use of destructive devices, radioactive, biological, explosive, chemical, other toxic agents, capture, stealing, damage, destruction of land, water and air vehicles, creation of panic and provoking of conflicts in places of accumulation of the population and when holding mass actions, damnifications or creations of threat of life, to health of the population, property of physical persons or legal entities by making of accidents catastrophic crashes of technogenic nature, distribution of threats by all means and methods, other actions of terrorist nature established by the legislation of the Republic of Uzbekistan and the universally recognized norms of international law;
the international terrorism - the terrorism which is going beyond the territory of one state.
The legislation on fight against terrorism consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about fight against terrorism then are applied rules of the international treaty.
The basic principles of fight against terrorism are:
legality;
priority of the rights, freedoms and legitimate interests of the personality;
priority of measures for the prevention of terrorism;
inevitability of punishment;
combination of public and secret methods of fight against terrorism;
one-man management in management of anti-terrorist operation, raised by forces and funds.
The prevention of terrorist activities is performed by carrying out complex of political, social and economic, legal and other preventive measures by state bodies, self-government institutions of citizens and public associations, and also the companies, organizations, the organizations.
It is forbidden:
terrorism promotion;
creation and functioning of terrorist groups and organizations;
accreditation, registration and functioning of legal entities, their departments (branches) and representations (including foreign and international organizations), involved in terrorist activities;
entry into the Republic of Uzbekistan of the foreign citizens and persons without citizenship involved in terrorist activities;
concealment of data and the facts about the preparing or committed acts of terrorism.
State bodies, public authorities on places, self-government institutions of citizens, public associations, the companies, organizations and the organizations, officials, and also citizens render assistance and necessary assistance to the state bodies fighting terrorism.
The cooperation of the Republic of Uzbekistan with foreign states, their law enforcement agencies, special services and the international organizations in the field of fight against terrorism is performed according to international treaties of the Republic of Uzbekistan.
