DECISION OF BOARD OF THE EURASIAN ECONOMIC COMMISSION

About approval of Requirements to constructions, rooms (parts of rooms) and (or) to the open areas (parts of the open areas) in the territory of which temporary storage of goods will be performed, completion of action of customs procedure of customs transit and (or) to be carried out customs control, to vehicles and workers of the legal entity applying for inclusion in the register of Authorized Economic Operators

According to the subitem 4 of Item 3 of Article 433 of the Customs code of the Eurasian Economic Union the Board of the Eurasian economic commission solved:

1. Approve the enclosed Requirements to constructions, rooms (parts of rooms) and (or) the open areas (parts of the open areas) in the territory of which temporary storage of goods will be performed, completion of action of customs procedure of customs transit and (or) to be carried out customs control, to vehicles and workers of the legal entity applying for inclusion in the register of Authorized Economic Operators.

2. This Decision becomes effective after 10 calendar days from the date of its official publication, but not earlier than the date of entry into force of the Agreement on the Customs code of the Eurasian Economic Union of April 11, 2017.

Requirements to constructions, rooms (parts of rooms) and (or) the open areas (parts of the open areas) in the territory of which temporary storage of goods will be performed, completion of action of customs procedure of customs transit and (or) to be carried out customs control, to vehicles and workers of the legal entity applying for inclusion in the register of Authorized Economic Operators

I. Requirements to constructions, rooms (parts of rooms) and (or) the open areas (parts of the open areas) in the territory of which temporary storage of goods will be performed, completion of action of customs procedure of customs transit and (or) to be carried out customs control

1. The legal entity applying for inclusion in the register of Authorized Economic Operators with issue of the certificate on inclusion in the register of Authorized Economic Operators of the second or third type (further – the legal entity), shall use constructions, rooms (part of rooms) and (or) the open areas (part of the open areas) in the territory of which temporary storage of goods will be performed, completion of action of customs procedure of customs transit and (or) to be carried out customs control (further – the territory of Authorized Economic Operator) provided that they provide:

a) safety of the goods and vehicles which are under customs control;

b) non-admission of making with the goods and vehicles which are under customs control, unloadings, overloads (transfer) and other cargo operations without the permission of customs authority;

c) possibility of carrying out concerning goods and vehicles of customs control.

2. The legal entity shall provide availability in the territory of Authorized Economic Operator:

a) firm (concrete, asphalt or other) coverings, including the handling platforms adjoining the specified territory;

b) parking for vehicles;

c) continuous barrier of the open areas (parts of the open areas) on all perimeter;

d) designations of customs control zones according to the procedure, the established legislation of state members of the Eurasian Economic Union on customs regulation, according to item 4 of Article 319 of the Customs code of the Eurasian Economic Union;

e) the place allocated for carrying out customs examination or customs goods inspection and vehicles;

e) technically operational sidings to the specified territory;

g) the organized access control and protection excluding unauthorized access to the objects located in the specified territory, including to shipping places (unloading) and storage of goods and to vehicles, and providing:

the admission to the specified objects of workers of the legal entity with implementation of their identification;

access to the specified objects of persons who are not workers of the legal entity with implementation of their identification and registration;

operational cancellation of the admission of the workers who stopped the activities at the legal entity to the specified objects and information systems;

h) control systems of entrance (departure) of vehicles and entrance (exit) of the faces equipped with the means of video surveillance functioning in the round-the-clock mode, allowing to perform viewing, record and storage of video information within 30 calendar days;

i) security and fire alarm, except for open areas (parts of the open areas);

j) the lighting allowing to provide video surveillance;

k) the weight equipment (measuring instruments) with the limits of weighing and indicators of accuracy of measurements conforming to requirements of the legislation of state members of the Eurasian Economic Union providing possibility of weighing of the goods assumed for placement in the specified territory, in particular on pallets, pallets and in other multireusable tare applied to transportation of goods;

l) pogruzo-unloading equipment and mechanisms necessary for carrying out customs control of goods;

m) rooms (places) equipped with office equipment and means of communication which are provided for the period of implementation by officials of customs authority of the powers when making of customs transactions by them carrying out customs control and execution of customs papers (if necessary the specified rooms (places) can be placed in close proximity to the specified territory).

II. Requirements to vehicles of the legal entity

3. Vehicles of the legal entity transporting (who is carrier) of goods, shall meet the requirements which are imposed to vehicles of international delivery for transportation of goods under customs seals and seals according to Article 364 of the Customs code of the Eurasian Economic Union.

III. Requirements to workers of the legal entity

4. Workers of the legal entity shall conform to the following requirements:

a) workers to whose job responsibilities the organization and (or) making of customs transactions belong shall have professional training in the field of customs affairs and (or) work experience in this sphere at least 2 years.

In the Republic of Armenia in addition to the specified requirements workers of the legal entity shall conform to other requirements established by the legislation of the Republic of Armenia;

b) the workers responsible for the organization of safety of the legal entity and protection of the territory of Authorized Economic Operator shall have professional training in the field of safety and protection and (or) work experience in this sphere at least 2 years;
