RESOLUTION OF THE PRESIDENT OF THE REPUBLIC OF UZBEKISTAN

About enhancement of procedure for material and financial provision of activity of the courts and judicial authorities

For the purpose of further ensuring independence of judicial authority, strengthening of material and financial provision of courts, bodies and organizations of justice, creation of proper conditions for their activities:

1. Agree with the offer of the Supreme Court, the Supreme judicial council, Ministry of Justice and Ministry of Finance of the Republic of Uzbekistan on abolition of Fund of development of courts and judicial authorities and its Executive directorate, with education:

Fund of development of judicial bodies;

off-budget fund of development of bodies and organizations of justice.

2. Determine that sources of forming of the income of Fund of development of judicial bodies are:

assignments in the amount of 40 percent (since October 1, 2021 - 5 percent) from the amounts arriving in the Government budget of the Republic of Uzbekistan from payment of the state fees on the cases considered by criminal, civil, administrative, economic and public courts;

assignments in the amount of 40 percent (since October 1, 2021 - 5 percent) from the amounts arriving in the Government budget of the Republic of Uzbekistan from payment of penalties on the cases considered by criminal, civil, administrative, economic and public courts;

assignments in the amount of 40 percent (since October 1, 2021 - 5 percent) from the amounts collected in the Government budget of the Republic of Uzbekistan on enforcement proceedings, except for penalties of tax debt for the realization account of property of the debtor;

income from placement of temporarily available funds on deposits of commercial banks;

other income which is not forbidden by the legislation.

3. Approve Regulations on Fonda of development of judicial bodies according to appendix No. 1.

4. Determine that management of activities of Fund of development of judicial bodies and distribution of its means is performed by the Supervisory board of Fund of development of judicial bodies (further - the Supervisory board) headed by the chairman of the Supreme Court of the Republic of Uzbekistan.

The chairman of the Supreme judicial council of the Republic of Uzbekistan, the director of the department of ensuring activity of the courts under the Supreme Court of the Republic of Uzbekistan (further - Department) and the director of the Higher school of judges under the Supreme judicial council of the Republic of Uzbekistan are part of the Supervisory board also on position (further - the Higher school).

5. Determine that since September 1, 2017 expenses on payment of surcharges and monthly allowances to official pay rates of judges, employees of courts and Department for qualification classes, class ranks and length of service, content of support personnel of courts and Department, lease (employment) of premises by judges, employees of courts, the Supreme judicial council of the Republic of Uzbekistan, Department and the Higher school, construction and repair of buildings and premises of courts, the Supreme judicial council of the Republic of Uzbekistan, Department and the Higher school, providing courts with vehicles, office traveling expenses of employees of courts, the Supreme judicial council of the Republic of Uzbekistan, Department and the Higher school, and also municipal and operational and other current expenses of courts, the Supreme judicial council of the Republic of Uzbekistan, Department and the Higher school are performed at the expense of means of the Government budget of the Republic of Uzbekistan.

6. Determine that sources of forming of the income of off-budget fund of development of bodies and organizations of justice are:

80 percent of the means levied by judicial authorities for state registration of non-state non-profit organizations, lawyer bureaus, firms, boards, symbolics of non-state non-profit organization, accreditation of the staff of non-state non-profit organizations who are foreign citizens and also members of their families, issue of duplicates of the certificate on state registration of non-state non-profit organization, symbolics, constituent documents of non-state non-profit organizations, issue of the duplicate of accreditation card, licensing of lawyer activities, and also the amounts of the penalties levied by judicial authorities;

income from placement of temporarily available funds on deposits of commercial banks;

other income which is not forbidden by the legislation.

7. Determine that means of off-budget fund of development of bodies and organizations of justice are used on:

material logistics of bodies and organizations of justice;

construction and repair of the equipment, buildings of bodies and organizations of justice;

material stimulation and social protection of employees of bodies and organizations of justice (housing construction for employees of judicial authorities, sanatorium and medical attendance, payment of awards, establishment of allowances, financial support, etc.);

office traveling expenses of employees of bodies and organizations of justice, including to foreign countries;

allocation to employees of judicial authorities, persons in need in improvement of housing conditions, non-interest loan for the term of no more than five years for acquisition of housing on the amount of no more thousandfold basic settlement size in the procedure established by the legislation;

payment of allowances and surcharges for class ranks and length of service to employees of bodies and organizations of justice;

payment of compensation for lease (employment) of premises to employees of bodies and organizations of justice in accordance with the established procedure;

training, advanced training and training of employees of bodies and organizations of justice, including the organization of visits to foreign countries, participation in conferences, seminars and other events held in foreign countries;

the organization of visits of delegations of foreign states, the international organizations arriving to the Republic of Uzbekistan on the questions connected with activities of bodies and organizations of justice;

municipal and operational and other current expenses of judicial authorities;

financing SUE Center of Legal Information Adolat and state unitary enterprise "The center of development of information and communication technologies in bodies and organizations of justice;

compensation of the damage caused by the notary owing to violation of the professional obligations, and corresponding expenses;
