Some questions of conducting examination of the project documentation on construction of facilities

According to article 31 of the Law of Ukraine "On regulation of town-planning activities" and to Item 7 of the Approval procedure of construction projects and the conducting their examination approved by the resolution of the Cabinet of Ministers of Ukraine of May 11, 2011 No. 560, I order:

1. Approve enclosed:

Criteria to which there shall correspond the expert organizations performing examination of construction projects;

Procedure for forming and maintaining the list of the expert organizations performing examination of construction projects.

2. Declare invalid the order of the Ministry of Regional Development, Construction and Housing of Ukraine of May 23, 2011 No. 53 "About approval of Criteria to which there shall correspond the expert organizations performing examination of construction projects", registered in the Ministry of Justice of Ukraine on June 16, 2011 at No. 719/19457.

3. To management of pricing, economy and contractual relations in construction (Sholomitsky L. M.) together with Legal department (Danish I. A.) submit this order in accordance with the established procedure on state registration to the Ministry of Justice of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control of execution of this order on the deputy minister Partskhaladze L. R.

Criteria to which there shall correspond the expert organizations performing examination of construction projects

1. The expert organizations irrespective of patterns of ownership (further - the expert organizations) performing examination of construction projects shall answer the following criteria:

1) availability of the status of the legal entity;

2) availability of the approved organizational structure of the expert organization according to the directions in which it is planned to carry out expertize, according to Item 6 of the Approval procedure of construction projects and the conducting their examination approved by the resolution of the Cabinet of Ministers of Ukraine of May 11, 2011 No. 560;

3) completeness of the expert organization by experts who conform to requirements of article 17 of the Law of Ukraine "About architectural activities" and have the qualification certificate which confirms possibility of performance of works on objects of the corresponding class of consequences (responsibility), and also other specialists meeting qualification requirements which work at permanent basis or attracted under civil agreements;;

4) availability of own or leased room for accommodation of personnel and archive of cases of construction projects which meets fire protection, sanitary standards and rules; material equipment of workplaces; program complexes by means of which examination of the project documentation will be performed that is documented; the Internet, e-mail, telephone communication that is documented;

5) availability of regime and confidential body according to article 21 of the Law of Ukraine "About the state secret" when conducting examination of projects which materials contain the state secret.

6) compliance with law in the sphere of town-planning activities, in particular about compliance of the project documentation to regulatory legal acts, construction regulations, standards and rules during preparation and provision to customers of expert reports which confirm quality of development of the project documentation on construction of facilities.

2. The expert organizations performing examination of construction projects of objects which on class of consequences (responsibility) belong to objects with considerable consequences (CC 3), except the requirements determined in Item of 1 these Criteria shall incorporate according to the directions in which it is planned to carry out expertize:

1) observance of standard rates concerning durability, reliability, durability of buildings and constructions, including on observance of standard rates on creation of the free vital circle for persons with disability and other handicapped national groups, - the experts working at permanent basis in ensuring mechanical resistance and stability of subjects to production and non-productive appointment; linear objects of engineering and transport infrastructure and examination of roads (in case of conducting examination of construction projects of such objects);

2) about conducting examination of estimate part of the project documentation - one or more experts who, work at permanent basis (in case of examination of construction projects which are constructed with attraction of budgetary funds, means of the state and municipal companies, organizations and organizations, and also the loans granted under the state guarantees (further - public funds)), concerning examination of estimate part of the project documentation;

3) observance of standard rates concerning sanitary and epidemiological wellbeing of the population, ecology, labor protection, energy saving, fire, technogenic, nuclear and radiation safety - experts who work at permanent basis or under civil agreements, on safety of life and health of the person, environment protection, ensuring sanitary and epidemiologic wellbeing of the population; safety of operation and requirements of labor protection, ensuring protection against noise; ensuring economy of energy; observance of requirements of fire and technogenic safety; ensuring nuclear and radiation safety (in case of conducting examination of the project documentation concerning nuclear and radiation safety);

4) about conducting examination of architectural concept of the construction project - the architect having the appropriate qualification certificate is attracted and works at permanent basis or under the civil agreement;

5) on observance of standard rates concerning operational safety of buildings and constructions and engineering support (according to Sections and parts of the project documentation: water supply and water disposal; heating, ventilation and air conditioning; gazo-and cold supply; electric equipment, electric lighting, communication and alarm system, automation of the engineering equipment, organization of construction; the master plan) - the experts and specialists working at permanent basis or under civil agreements;
