Based on provisions of article 16 of the Law No. 467-XV of November 21, 2003 on informatization and the state information resources (The official monitor of the Republic of Moldova, 2004, Art. No. 6-12, 44), with subsequent changes, DECIDES: the Government

1. Approve the Technical concept of Information and judicial system it (is applied).

2. To assign ensuring implementation, functioning and development of Information and judicial system to the Ministry of Justice by means of Agency on administration of degrees of jurisdiction.

2. To enable the realization of provisions of this resolution for the account and within the financial resources which are annually provided in the government budget and also from other means, according to the law.

Technical concept of Information and judicial system

Introduction

Realization of independent, impartial, reliable and effective judicial system represents necessary condition for ensuring rule of law and the principles of the constitutional state. Measures for strengthening of independence of judicial system shall promote realization of the principle of separation of the power in the state.

Reform of judicial system assumes institutional restructuring, and also appendix of financial efforts for use of modern information technologies. Thus, it is necessary to create Information and judicial system (further - ISS) which owner is the Agency on administration of degrees of jurisdiction subordinated to the Ministry of Justice.

Creation and implementation (ISS) is caused by the following reasons:

1) the lowered degree of transparency of activities of degrees of jurisdiction;

2) lack of safety of information with limited availability;

3) the lowered capability of the prevention and fight against corruption in judicial system;

Chapter I. General provisions

1. ISS is the automated information system consisting of set of information technologies and resources, the interconnected technical means of the software and techniques intended for registration, storage, processing, use of information concerning court affidavits and cases from the moment of their registration and until archiving and publication. On the basis of ISS information resource - the Register of legal cases is formed (further - RSD).

2. RSD represents the systematized data set about the statements, cases attached to them documents, judicial sessions, judicial determinations and resolutions. RSD is departmental state information resource.

3. The purpose of ISS consists in creation of the Register of legal cases and submission of updated information to bodies of public management, physical persons and legal entities, according to the procedure, established by the legislation of the Republic of Moldova. ISS represents set of the automated workplaces (ARS) of staff of offices, courts, secretaries of judicial sessions and other officials.

4. In sense of this Technical concept the following concepts mean:

set of means of the software and the hardware - set of the programs and technical means providing realization of information processes;

the database - matching of the data organized according to the conceptual structure describing the main characteristics of these data and the relation between their compound units, intended for one or more scopes;

the identifier of information object – one of properties of information object which value is unambiguous and remains neizmenimy throughout the entire period of existence of object in ISS;

the qualifier – set of values of certain characteristics of subject and the digital or alphabetic codes corresponding to them;

information object - virtual representation of subject to registration as a part of information resource;

information resource - set of information containing in ISS organized according to the established requirements and the current legislation;

personnel of IT – specialized personnel in the field of information technologies;

call center – the center for processing of phone calls;

procedural material – the acts which are taken out by degrees of jurisdiction or arrived to them for consideration.

5. The purpose of system is:

1) creation and development of information resource of degrees of jurisdiction for the purpose of accumulating, systematization, updating, protection of information decisions of degrees of jurisdiction (the considered cases, the passed decisions, statistical data, etc.) and ensuring adequate level of personal data protection;

2) development of flexible technical solution and modulation, the allowing improvement of activities of judicial system;

3) ensuring honesty, improvement of quality of court resolution;
