About approval of the Regulations on procedure for carrying out tender by determination of authorized rating agencies and procedure for maintaining the State register of authorized rating agencies

According to Article 4-1, to Items 31, 33, 35 parts two of Article 7, to Item 13 of article 8 of the Law of Ukraine "About state regulation of the security market in Ukraine" the National commission on securities and the stock market RESHILA:

1. Approve Regulations on procedure for carrying out tender by determination of authorized rating agencies and procedure for maintaining the State register of authorized rating agencies which are applied.

2. Declare invalid the decision of State commission on securities and the stock market of June 23, 2006 No. 444 "About approval of the Procedure for maintaining the State register of authorized rating agencies and issues of Certificates on inclusion in the State register of authorized rating agencies", registered in the Ministry of Justice of Ukraine on July 12, 2006 at No. 823/12697 (with changes).

3. Declare invalid the decision of the National commission on securities and the stock market of March 23, 2015 No. 364 "About approval of the Regulations on tender by determination of authorized rating agencies", registered in the Ministry of Justice of Ukraine on April 14, 2015 for No. 416/26861 (with changes).

4. Bring in the Procedure for provision of information by authorized rating agencies approved by the decision of the National commission on securities and the stock market of December 11, 2012 No. 1767, registered in the Ministry of Justice of Ukraine on January 2, 2013 at No. 25/22557 (with changes), the following changes:

To add 1) after Item 8 with new Items 9 - 12 following contents:

"9. In the terms determined by Item 2 presents of the Procedure for submission of annual Information, authorized rating agency places (updates if necessary) on the website on the Internet the following information:

1) structure of property of rating agency with indication of information on founders and/or members of rating agency and quantity and share value (the size of the shares, shares) which are in their property; founders, shareholders, members of those legal entities who have more than 10% in the authorized capital of rating agency and concerning subjects of managing in which the rating agency owns or manages (uses) shares (shares, shares), in any form;

2) organizational structure and information on corporate management of rating agency (with indication of information concerning officials of governing bodies of rating agency and quantity and share value (the size of the shares, shares) which are in their property) in any form and the copy of the approved domestic situations of activities of rating agency;

3) information on completion by personnel of rating agency and qualification of such personnel with indication of the number of workers in any form;

4) information concerning branches of rating agency and other separate divisions in any form;

5) the description of the procedures and methodologies applied to implementation and review of credit ratings in any form;

6) information on the politician and the procedures intended for identification, management and disclosure of information concerning any conflicts of interest in any form;

7) information of rather rating analysts in any form;

8) information on the politician in the field of remuneration and performance appraisal in any form;
