1. Approve the enclosed Rules of implementation of activities of research test fire laboratories.

2. To provide to committee on emergency situations of the Ministry of Internal Affairs of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction of the copy in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the deputy minister of internal affairs of the Republic of Kazakhstan Ilyin Yu. V. and Committee on emergency situations of the Ministry of Internal Affairs of the Republic of Kazakhstan (Becker V. R.).

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of implementation of activities of research test fire laboratories

Chapter 1. General provisions

1. These rules of implementation of activities of research test fire laboratories (further – Rules) determine procedure for the organization and implementation of activities of research test fire laboratories (further – IIPL) territorial subdivisions of the Ministry of Emergency Situations of the Republic of Kazakhstan.

2. In these rules the following concepts are used:

1) IIPL - the division of bodies of civil protection performing activities for research of the fires, measure definition of fire danger of substances and materials (carrying out testing), carrying out tool methods of inspection;

2) the specialist of IIPL - the employee of bodies of civil protection who is directly researching the fires, measure definition of fire danger of substances and materials (carrying out testing), carrying out tool methods of inspection, having special knowledge and performing activities according to the Criminal Code of Kazakhstan, the Code of penal procedure of the Republic of Kazakhstan, the Code of Administrative Offences of the Republic of Kazakhstan and the Entrepreneurial code of the Republic of Kazakhstan;

3) the IIPL technical means - special devices, the equipment, devices, materials applied to research of the fires, measure definition of fire danger of substances and materials (carrying out testing), carrying out tool methods of inspection;

4) tool methods of inspection - evaluating working capacity and compliance of systems and elements of fire protection of objects to requirements of fire safety using the IIPL technical means;

5) the conclusion of the specialist of IIPL - the official document on research of the fire, assessment of working capacity and compliance of systems and elements of fire protection of objects to requirements of fire safety reflecting content of research and conclusions (further - the conclusion);

6) the state control inspector in the field of fire safety - the official of division of bodies of civil protection, the exercising state control in the field of fire safety;

7) individual research - type of research of the fire which production is performed by one specialist of IIPL;

8) the additional research - type of research of the fire which production is caused by need of the solution of the additional questions connected with the previous research is conducted by the same or other specialist of IIPL. In case of the order of production of additional research the conclusion of the previous research is submitted to the specialist of IIPL;

9) commission research - type of research of the fire of difficult category which is performed by at least than two specialists of IIPL of one specialty;

10) complex research - fire research type on the basis of different industries of knowledge, production which specialists of different qualifications within the competence perform;

11) additional inspection using tool methods of inspection - the type of tool method of inspection caused by need of the solution of the additional questions connected with the previous inspection.

Chapter 2. Organization and implementation of activities of IIPL

3. When planning activities of IIPL the main directions according to functions and accounting of features of operational (fire) situation are provided:

1) condition and dynamics of fire situation in the region, results of work on investigation of the offenses connected with the fires;

2) condition of organizational support and shortcomings when implementing activities of IIPL;

3) results of accomplishment of the actions provided by the previous work plans IIPL.

4. Activities of IIPL provide:

1) qualified use of special knowledge in the field of fire safety for application in criminal, administrative sudoproizvodstvo and other activities of bodies of civil protection;

2) participation of specialists of IIPL in surveys of places of incidents and other investigative actions, using the IIPL technical means, for rendering assistance in collecting, research and assessment of proofs by explanation to participants of investigative actions, the questions entering its competence;
