For the purpose of ensuring realization of the right of everyone to the favorable environment and reliable information about its condition, enhancement of mechanisms of consideration with federal executive bodies of results of public control in the field of environmental protection (public environmental control) the Government of the Russian Federation decides:

1. Determine that the Ministry of Natural Resources and Environmental Protection of the Russian Federation:

performs financing of works on creation, development and operation of federal state information system of public control in the field of environmental protection and environmental management within the budgetary appropriations provided in the federal budget for the corresponding year on management and management in the field of the established functions;

is operator and the state customer of creation, development and operation of federal state information system of public control in the field of environmental protection and environmental management;

performs coordination of activities of federal executive bodies for use of federal state information system of public control in the field of environmental protection and environmental management.

2. Approve the enclosed Regulations on federal state information system of public control in the field of environmental protection and environmental management.

3. Recommend to executive bodies of subjects of the Russian Federation to create and provide functioning of regional state information systems which information resources are intended for the subsequent integration with information resources of federal state information system of public control in the field of environmental protection and environmental management.

Regulations on federal state information system of public control in the field of environmental protection and environmental management

1. This Provision determines the creation purpose, appointment, structure and procedure for functioning of federal state information system of public control in the field of environmental protection and environmental management (further - information system of public control).

2. The information system of public control represents the federal state information system providing collection and processing of addresses of the citizens, public associations and other non-profit organizations containing the data specifying availability of violation of the law of the Russian Federation in the field of environmental protection and environmental management by means of use of information and telecommunication technologies including the Internet (further respectively - users, information messages), provision by federal executive bodies to users of messages in electronic form on results of consideration of information messages, and also forming, processing and provision of data of information and analytical nature and statistical data in the field of environmental protection and environmental management.

3. The information system of public control is created for the purpose of:

a) ensuring realization of the right of everyone to the favorable environment and prevention of violation of the law of the Russian Federation in the field of environmental protection and environmental management, on receipt of information on environmental measures;

b) establishments of mechanisms of consideration by the Ministry of Natural Resources and Environmental Protection of the Russian Federation, Federal Service on supervision in the field of environmental management, other federal executive bodies using information system of public control (further - authorized federal executive bodies), results of public control in the field of environmental protection (public environmental control);

c) increases in efficiency of public administration in the field of environmental protection, including activities of state control (supervision) bodies in the specified sphere.

4. The information system of public control is intended for the solution of the following tasks:

a) ensuring information exchange of users with authorized federal executive bodies concerning environmental protection and environmental management;

b) identification of violations of the law of the Russian Federation in the field of environmental protection and environmental management for acceptance of stipulated by the legislation measures of the Russian Federation for suppression and (or) elimination of effects of the revealed violations;

c) consolidation of information resources in the field of environmental protection and environmental management.

5. Functions of information system of public control are:

a) collection, systematization (accounting) and the analysis of information messages with possibility of appendix to them of photographing and video filming, specifying of geographical coordinates of sources of negative impact on the environment and descriptions of the expected facts of violation of the law of the Russian Federation in the field of environmental protection and environmental management, data of public cadastral maps which maintaining is performed according to the Federal Law "About Cadastral Activities" and the Federal Law "About State Registration of the Real Estate";

b) operational exchange between authorized federal executive bodies the data specifying availability of violation of the law of the Russian Federation in the field of environmental protection and environmental management for acceptance of stipulated by the legislation measures of the Russian Federation for suppression and (or) elimination of effects of the revealed offenses;

c) informing users on the revealed violations in the field of environmental protection and environmental management, the taken stipulated by the legislation measures of the Russian Federation for suppression and (or) elimination of effects of the revealed violations;

d) forming, processing and provision of data of information and analytical nature and statistical data in the field of environmental protection and environmental management, including data on offenses in the field of environmental protection and environmental management, the taken measures for suppression and (or) elimination of such offenses, involvement of perpetrators to responsibility, other response measures.

6. The principles on the basis of which the information system of public control is created and functions are:

a) observance of the right of everyone to the favorable environment and the right to reliable information about its condition;

b) observance of the rights of citizens to personal privacy, personal and family secret, protection of their honor and goodwill, right of the organizations to protection of their goodwill;

c) openness, availability, reliability and timeliness of provision of information on the activities of federal executive bodies performed by means of information system of public control;

d) gratuitousness of access to information resources of information system of public control;
