About approval of the Regulations on procedure for designing, construction and reconstruction of highways

According to articles 33 of the Law of the Kyrgyz Republic "About highways", articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on procedure for designing, construction and reconstruction of highways, according to appendix.

2. This resolution becomes effective after fifteen days from the date of official publication.

Regulations on procedure for designing, construction and reconstruction of highways

1. General provisions

1. This Provision regulates procedure for designing, construction and reconstruction of the highways financed by means of republican and local budgets, and also other sources determined by the decision of the Government of the Kyrgyz Republic.

2. In this Provision the following terms are used:

the preproject documentation - the document proving technical, economic feasibility and sales opportunity of the project on construction or reconstruction of the highway. Enter the preproject documentation: the feasibility statement, results of researches and engineering researches, technological and constructive calculations, prototypes and results of inspections of objects, and also the input data and materials necessary for decision making about development of the project documentation and the subsequent projects implementation;

design assignment (task for development of the project documentation) - the document constituted and approved by the customer who is issued to the project organization in case of the conclusion of the works agreement (contract). The design assignment sets basic data, the planned parameters, sources of engineering support for the planned object, utilization properties and other requirements to designed project of construction, complexity, staging and terms of designing;

the customer - public authorities, local authorities of the government and local government bodies (on balance) which is in maintaining the highway;

major repair (rehabilitation) - complex of works during which the complete recovery and increase in operability of road clothes and covering, subgrade and road constructions is made is performed change of worn-out designs and details or their replacement on stronger and long-lasting, in necessary cases geometrical parameters of the road taking into account growth of traffic load and axial loads of cars within the regulations corresponding to the category established for the repaired road without increase in width of subgrade on the main extent of the road increase;

reconstruction of the highway - complex of works in case of which accomplishment change of parameters of the highway, its sites leading to change of class and (or) category of the highway or involving change of border of right of way of the highway is performed;

highway construction - complex of engineering, infrastructure and management processes on highway construction;

the schedule of mobilization of the main machinery and equipment - the document included in contractual documentation after signing and in subsequent being integral part of the agreement which contains information on terms and obligations of contract organization on providing the project with the machinery and equipment necessary for agreement performance;

the general works schedule - the document included in contractual documentation after signing and in subsequent being integral part of the agreement which contains summarized information on terms and obligations on execution of specific scopes of work on the project, in physical and monetary value;

the annual works schedule - the document constituted on the basis of the general works schedule which contains the detailed information about terms and obligations on execution of scopes of work on the project in the corresponding year;

acceptance for operation - acceptance of the highway finished with construction (or its site) or road construction, equipped according to the project documentation approved in accordance with the established procedure and requirements of the corresponding technical regulations, necessary elements of arrangement and situation, and also systems for their content and safety control of traffic;

incoming inspection - verification of presence of the relevant accompanying documents, the used equipment, the equipment, construction materials and products;

the certificate of payment - the document determining amount of completed work for the accounting period and the amount which is subject for payment.

Forecasting of design and exploration work on objects of road economy for the next year is performed by the customer based on materials of diagnostics of condition of the existing highways, road constructions and objects of road infrastructure, according to the approved criteria authorized state body in the field of transport and roads for inclusion in the work plan, and also programs of perspective development of highways.

4. The structure of design assignment of highways is established according to requirements of rules of designing of highways of the Technical regulation of the Customs Union "Safety of highways" (TP of TS 014/2011) (further - the technical regulation).
