ORDER OF THE MINISTER OF INVESTMENTS AND DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of providing with aeronautical information in civil aviation

(as amended on 08-11-2024)

According to subitem 41-18) of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" PRIKAZYVAYU:

1. Approve the enclosed Rules of providing with aeronautical information in civil aviation.

2. Declare invalid the following orders:

1) the order of the acting minister on investments and development of the Republic of Kazakhstan of February 24, 2015 No. 169 "About approval of Rules of providing air vehicles with aeronautical information of operators" (No. registered in the Register of state registration of regulatory legal acts 10605, published on April 13, 2015 in information system of law of Ad_let);

2) the order of the acting minister on investments and development of the Republic of Kazakhstan of November 28, 2016 No. 818 "About modification and amendments in the order of the acting minister on investments and development of the Republic of Kazakhstan of February 24, 2015 No. 169 "About approval of Rules of providing air vehicles with aeronautical information of operators" (No. registered in the Register of state registration of regulatory legal acts 14580, published on January 11, 2017 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan).

3. To provide to committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printed publicity materials;

4) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2), 3) and 4) this Item.

4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of providing with aeronautical information in civil aviation

Chapter 1. General provisions

1. These rules of providing with aeronautical information in civil aviation (further - Rules) are developed according to subitem 41-18) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and determine procedure for providing with aeronautical information in civil aviation.

These rules do not extend on the physical persons or legal entity providing different information / data (in text and/or cartographic type in electronic and/or on paper) constituted on the basis of the processed aeronautical information (aeronautical data) published in products of aeronautical information which provision is provided by aeronautical information service of the supplier of the aeronautical servicing which is the state company subordinated to authorized body in the field of civil aviation.

2. The main determinations and terms used in these rules:

1) absolute altitude - distance down from mean level of the sea to the level, point or the object accepted for point;

2) the absolute/relative altitude of the scheme - the published absolute/relative altitude used in case of determination of vertical profile of the mission profile on the minimum absolute/relative obstacle clearance altitude or above where it is established;

3) air fixed service - the service of telecommunication between the certain fixed Items intended mainly for safety control of air navigation, and also regularity, efficiency and profitability of air traffics;

4) the specification of information product - the detailed description of data array or set of data arrays together with the additional information which will allow to create them, to deliver to other party and to provide their use by other party;

5) switch point - point in which in case of aircraft flight on the servicing route segment air traffic determined by means of orientation to omnidirectional OVCh-radio beacons transfer of the main navigation orientation from the means which is behind the air vehicle on the following means which is ahead of it is expected;

6) aspects of human factor - the principles applicable to design processes, certification, trainings, maintenance and operational activities in aircraft and aimed at ensuring safe interaction between the person and other components of system by means of proper accounting of opportunities of the person;

7) aeronautical information - information obtained as a result of collection, the analysis and data processing for the purposes of flight servicing of air vehicles, air traffic maintenance and air traffic control;

8) service of management of aeronautical information – the service created in specifically established action area which bears responsibility for provision of the aeronautical information (aeronautical data) necessary for safety control, regularity and efficiency of aerial navigation;

9) the collection of aeronautical information - the publication issued or authorized by the Republic of Kazakhstan which contains the long-term aeronautical information which is important for air navigation;

10) amendment to the collection of aeronautical information - the temporary changes made to information containing in the collection of aeronautical information, and represented on separate pages;

11) the correction to the collection of aeronautical information - the permanent changes made to information, containing in the collection of aeronautical information;

12) the circular letter of aeronautical information – the notification containing information which does not require release of NOTAM or its inclusion in the collection of aeronautical information, but which concerns safety issues of flights or aeronautical, technical, administrative and legal issues;

13) the electronic collection of aeronautical information – the collection of aeronautical information which is provided on the electronic medium, or by means of Internet resource in the format allowing to display it on the screen of the computer and to unpack on paper;

14) aeronautical data - statement of aeronautical actual data, concepts or instructions in the formalized procedure suitable for communication, interpretations or processings;

15) the aeronautical chart - the conditional image of the site of the land surface, its relief and artificial features which is specially intended for air navigation;

16) the supplier of aeronautical servicing – the legal entity providing air traffic management and (or) other aeronautical servicing;

17) permission of data – the number of units or digits determining procedure for the value used measured or calculated;

18) authorized body in the field of civil aviation - the central actuator performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

19) authorized organization in the field of civil aviation – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, aviation safety and aviation safety;

20) area navigation - the navigation method allowing air vehicles to carry out flight on any desirable trajectory within the action area of terrestrial or satellite navaids or in the limits determined by opportunities of autonomous means or their combination;

21) the minimum absolute altitude of flight in zone - the minimum absolute altitude which is subject to use in instrument meteorological conditions and providing the minimum inventory of height over obstacles within the established zone which is usually determined by parallels and meridians;

22) information product – data array or set of data arrays which answers the specification of information product;

23) instrument approach chart – series of in advance planned maneuvers which are carried out on flight control instruments, in case of observance of the established requirements providing prevention of collision with obstacles from checkpoint of initial approach or, in appropriate cases, from the beginning of the established arrival route to point from where landing can be executed and if landing is not executed, then to point from which criteria of flight of obstacles in the waiting area or on route are applied;

24) exceeding – distance down from mean level of the sea to point or the level of earth's surface or the related object;

25) the absolute altitude of arrival in the terminal area – the smallest absolute altitude which will provide the minimum inventory of height in 300 meters (1000 foot) over all objects located in alignment of arch of circle with a radius of 46 kilometers (25 nautical miles) with the center in checkpoint of initial approach or if the point of initial approach is absent, checkpoint of intermediate approach, limited to the straight lines connecting the ends of this arch to point of intermediate approach;

26) air transit route - the established route of movement of helicopters by air;

27) airfield – certain site terrestrial or surface of the water (including any buildings, constructions and the equipment), intended fully or partially for arrival, departure and movement on this surface of air vehicles;

28) airway – controlled airspace (or its part) in the form of corridor;

29) checkpoint of airfield – the point determining the geographic location of airfield;

30) route of air traffic maintenance – the established route which is intended for movement direction of flow for the purpose of ensuring air traffic maintenance;

31) air traffic maintenance – flight and information servicing, the emergency notification, dispatching air traffic maintenance (district dispatching servicing, dispatching servicing of approach or airdrome dispatching service);

32) cartographic data of airfield - the data collected for the purpose of creation of airfield cartographic information;

33) the cartographic database of airfield - selection of the cartographic data of airfield systematized and presented in the form of set of the structured data;

34) exceeding of airfield – exceeding of the highest point of the landing area;

35) operational minima of airfield - restriction of use of airfield for:

take-off, expressed in the sizes RVR and/or visibility and, if necessary, by overcast parameters;

the landings in case of accomplishment of precision approaches and landings expressed in the sizes of visibility and/or RVR and absolute/relative altitude of decision making corresponding to operational category;

the landings in case of accomplishment of landing approaches and landings with guidance in elevation expressed in sizes of visibility and/or RVR and absolute/relative altitude of decision making;

the landings in case of accomplishment of inexact landing approaches and landings expressed in sizes of visibility and/or RVR, MDA/H and, if necessary, by overcast parameters;

36) base - any size or number of sizes which can serve as the beginning or basis of counting of other sizes;

37) relief – the roughnesses of earth's surface transferred on aeronautical charts by horizontals, tone hypsometry, washing or elevation marks;

38) signs – the devices established over earth level for display to their panels of information in the form of texts, symbols, letters or digits or their combinations, necessary for the organization of land movement in airfield of air vehicles and/or vehicles which depending on circumstances can be as with permanent information the transferring only one message, and with the variable information providing possibility of transfer of several in advance determined messages or, if necessary, the termination of transfer of any information;

39) product of aeronautical information - the aeronautical data and aeronautical information provided in the form of arrays of digital data or in the standardized format in printed form or on electronic media. Products of aeronautical information include:

the collection of aeronautical information, including changes and amendments;

circular letters of aeronautical information;

aeronautical charts;

NOTAM;

arrays of digital data;

40) validation - confirmation by means of submission of objective certificates of the fact that the requirements intended for specific intended use or application are executed;

41) vektoreniye – ensuring navigation guidance of air vehicles by means of specifying of certain rates on the basis of use of watch system of air traffic maintenance;

42) verification - confirmation by means of submission of objective certificates of the fact that the established requirements were fulfilled;

43) geoid wave (geoid height) – distance (positive value or negative value) between surface of geoid and surface mathematically certain reference ellipsoid;

44) geoid – the equipotential surface of gravitational field of Earth matching with nonperturbed mean level of the sea and its continuation under continents. The geoid has irregular shape owing to local gravitational perturbations and the direction of gravitational force represents perpendicular to geoid surface in any point;

45) system of geodetic coordinates - the minimum set of the parameters necessary for position determination and orientation of local reference system in relation to global system of counting/coordinates;

46) geodetic distance - the smallest distance between any two points on mathematically certain ellipsoidal surface;

47) glide path – the decrease profile established for vertical targeting on final approach;

48) Gregorian calendar – the commonly accepted calendar, is introduced in 1582 for the first time for determination of year which more precisely in comparison with Julian calendar corresponds to solar year;

49) accuracy – degree of compliance of the settlement or measured value to true value. Measuring accuracy of location is expressed by distance from the declared location within which as it is established with certain degree of probability, there is true location;

50) level - the general term relating to provision in the vertical plane being in aircraft flight and the relative height, absolute altitude or the flight level meaning in appropriate cases;

51) quality of data – degree or probability level of the fact that provided data meet user requirements of data from the point of view of accuracy, permission, integrity (or the equivalent level of guarantees), traceabilities, timeliness, completeness and format;

52) set of data arrays – set of the data arrays meeting the identical specification of product;

53) data array - certain data set;

54) communication "the dispatcher - the pilot" on air-ground data link – communicating device between the dispatcher and the pilot for the purpose of air traffic maintenance with use of air-ground data link;

55) traceability of data - degree of probability that the system or information product can register the changes made to this product, allowing to perform end-to-end check from the end user to the originator;

56) data format - the structure of elements of data, accounting records and files organized for compliance to standards, specifications or quality requirements of data;

57) completeness of data - degree of probability that all data necessary for ensuring intended use are provided;

58) timeliness of data - degree of probability that data are applicable to the period of their intended use;

59) the scheme of go-around – procedure to which it is necessary to adhere in case of impossibility of continuation of landing approach;

60) missed approach point – point in instrument approach chart in which or to which for providing the minimum inventory of height over obstacles flight according to the ordered scheme of go-around shall begin;

61) the touchdown zone – the site of landing strip behind its threshold intended for the first contact of landing strip with the landing airplanes;

62) the touchdown zone and separation – the site bearing loading on which the helicopter can carry out landing or separation;

63) the area – the Earth's surface with such natural elements as mountains, hills, ridges, valleys, accumulations of water, eternal ice and snow, excepting artificial obstacles;

64) the surface of accounting of data on area obstacles – the certain surface used for the purpose of creation of data on obstacles (area);

65) point of way – the specific geographical Item used for determination of route of area navigation or flight path of the air vehicle applying area navigation. Points of way are designated or:

point of way Fly-bay – point of way which provides turn lead for the purpose of providing exit to the following route segment or the scheme on tangent; or

point of way "flayover" – point of way in which the turn for the purpose of exit to the following route segment or schemes begins;

66) track line – projection of flight path of the air vehicle to the Earth's surface which direction in any its point is usually expressed in degrees of the corner counted from the northern direction (true, magnetic or conditional meridians);

67) working area – the part of airfield intended for take-off, landing and taxing of air vehicles, consisting of the maneuvering area and the platform (platforms);

68) the displaced landing strip threshold – the threshold located not at landing strip end face;

69) isogon - the line on the map or the scheme connecting all points to identical magnetic declination during certain era;

70) the absolute altitude of flight of obstacles – the minimum absolute altitude over exceeding of the corresponding threshold of landing strip or in appropriate cases over exceeding of airfield, used for ensuring compliance with the corresponding criteria of flight of obstacles;

71) relative obstacle clearance altitude – the minimum relative height over exceeding of the corresponding threshold of landing strip or in appropriate cases over exceeding of airfield, used for ensuring compliance with the corresponding criteria of flight of obstacles;

72) zone, free from obstacles – airspace over inner surface of landing approach, inner transitional surfaces and the surface of go-around in case of balked landing and part of the flying strip limited to these surfaces in which no motionless obstacle, except lung on weight and on the fragile basis, necessary for the air navigation purposes acts;

73) the minimum absolute altitude of flight of obstacles – the minimum absolute altitude of flight on certain site which provides necessary inventory of height over obstacles;

74) strip, free from obstacles – the certain rectangular site which is under control of the relevant authority terrestrial or surface of the water, the airplane chosen or prepared as the suitable site, over which can make part of initial climb up to the established height;

75) obstacle - all motionless (temporary or permanent) and mobile objects or part them, which:

are placed in the zone intended for movement of air vehicles on surface;

tower over the certain surface intended for safety control of air vehicles in flight;

are outside these certain surfaces and are regarded as constituting danger to aerial navigation;

76) the following expected user - the organization which obtains aeronautical data or information from aeronautical information service;

77) reversal procedure – the scheme allowing the air vehicle to change the direction on the initial site of instrument approach chart. This maneuver can include procedure turns or base-leg turns;

78) horizontal – the line on the map or the scheme connecting points of equal exceeding;

79) the image - submission of information to people;

80) the mission profile in the waiting area – in advance determined maneuver allowing the air vehicle to remain within certain airspace waiting for the subsequent permission;

81) traceability - opportunity to trace history, application or the location of what is considered;

82) the danger area – airspace of the established sizes within which during certain periods of time the activities constituting danger to flights of air vehicles can be performed;

83) the dangerous site - the site on the aerodrome movement area where already took point of impact or unauthorized departures on landing strip or, exists potential risk of such cases and where special attention of pilots/drivers is required;

84) application - manipulation data and their processing taking into account user requirements;

85) landing direction indicator - the device for visual specifying of the direction of take off and landing established at the moment;

86) zone of final approach and take-off – the established zone over which the final stage of maneuver of landing approach to the mode of hanging or landing is completed and with which the take-off maneuver begins. When the zone of final approach and take-off be used by helicopters with class flight technical characteristics 1, this established zone includes the located rejected take-off area;

87) terminal phase of landing approach – the site of instrument approach chart within which exit in alignment of landing strip and decrease is made for landing;
