1. Approve the enclosed Rules of response of command of military units and bodies of military police of Armed Forces of the Republic of Kazakhstan to information on plunder, loss of weapon and ammunition or unauthorized leaving by the serviceman of location of military unit with weapon.

2. To provide to head department of military police of Armed Forces of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan in paper and electronic types within ten calendar days from the date of state registration;

3) placement of the order on Internet resource of the Ministry of Defence of the Republic of Kazakhstan after its first official publication;

4) the direction of data in Legal department of the Ministry of Defence of the Republic of Kazakhstan on execution of the actions provided by subitems 1), 2) and 3) of this Item within ten calendar days from the date of state registration.

3. To impose control of execution of this order on the First Deputy Minister of Defence - the chief of the General Staff of Armed Forces of the Republic of Kazakhstan.

4. Bring this order to officials in the part concerning them.

5. This order becomes effective after ten calendar days from the date of its first official publication.

Rules of response of command of military units and bodies of military police of Armed Forces to information on plunder, loss of weapon and ammunition or unauthorized leaving by the serviceman of location of military unit with weapon

Chapter 1. General provisions

1. These rules of response of command of military units and bodies of military police of Armed Forces to information on plunder, loss of weapon and ammunition or unauthorized leaving by the serviceman of location of military unit with weapon (further - Rules) determine procedure for reaction of command of military units and bodies of military police of Armed Forces of the Republic of Kazakhstan (further - military units and bodies of military police) on information on plunder, loss of weapon and ammunition or unauthorized leaving by the serviceman of location of military unit with weapon.

2. Command of military units and bodies of military police perform search of the kidnapped person, the lost weapon, ammunition and establish the location of the serviceman who self-willedally left location of military unit with weapon (further - SOCh with weapon).

Chapter 2. Operations procedure of officials of military units and bodies of military police in case of receipt of information on plunder, loss of weapon and ammunition

In case of receipt of information on plunder, loss of weapon and ammunition the person on duty on military unit immediately reports on the commander of military unit, in bodies of military police, military and investigative and territorial authorities of internal affairs, military prosecutor's office and bodies of military counterintelligence for the place of dislocation of military unit.

4. Command of military unit immediately:

1) notifies the chief of garrison;

2) takes measures for ensuring protection of the scene and restriction of access to the scene of strangers before arrival of operational-investigations group, appoints the senior of group of cordon and determines the number of forces and the funds raised to protection of the scene.

5. Within three hours from the moment of receipt of information command of military unit sends the report on plunder, loss of weapon and ammunition to the higher headquarters, and also in writing informs military prosecutor's office, bodies of military counterintelligence, military and investigative and territorial authorities of internal affairs, bodies of military police.

At the request of the staff of law-enforcement bodies and bodies of military police provides the materials important for case, allocates specialists for carrying out investigative actions, organizes check of the area, adjacent to military unit, carries out search of availability of weapon and ammunition, inspects rooms and buildings in the territory of part.

6. The person on duty on body of military police in case of receipt of information on plunder, loss of weapon and ammunition without delay:

1) registers information according to Article 179 of the Code of penal procedure of the Republic of Kazakhstan (further - the Code of Criminal Procedure of RK);

2) directs task force to the scene;

3) in writing reports on incident on the chief of body of military police and the operations duty officer of Head department of military police of Armed Forces of the Republic of Kazakhstan.

Chapter 3. Operations procedure of command of military units and bodies of military police in case of receipt of information on unauthorized leaving by the serviceman of part or the duty station with weapon

7. In case of receipt of information on unauthorized leaving by the serviceman of part or the duty station with weapon command of military unit will organize holding the actions specified in Chapter 2 of these rules and also:

1) within three hours the report, and written messages in military prosecutor's office, bodies of military counterintelligence, military and investigative and territorial authorities of internal affairs, law-enforcement bodies on transport sends to the higher headquarters, bodies of military police, commandant's office of military messages on modes of transport in the place of dislocation of military unit.
