About formation of Committee of Fund of guaranteeing household deposits concerning consolidation and asset sale, delegation to it part of powers of executive directorate of Fund of guaranteeing household deposits and approval of Changes in some regulatory legal acts of Fund of guaranteeing household deposits

According to Item 10 parts one, to Items 1-1 and 2 of part five of Article 12 and article 51 of the Law of Ukraine "About system of guaranteeing household deposits" the executive directorate of Fund of guaranteeing household deposits solved:

1. Form Committee of Fund of guaranteeing household deposits concerning consolidation and asset sale.

2. Delegate to Committee of Fund of guaranteeing household deposits concerning consolidation and asset sale of power of executive directorate of Fund of guaranteeing household deposits for approval according to requirements of regulatory legal acts concerning sale of property (assets) of the liquidated bank:

terms and actions of pre-sale preparation of individually certain property (assets) of the liquidated bank, which cost (which) does not exceed the limit set by executive directorate of Fund of guaranteeing household deposits;

methods, procedure and sales terms of individually certain property (assets) of the liquidated bank, which cost (lot cost which pool) does not exceed the limit set by executive directorate of Fund of guaranteeing household deposits and also contents of information on the chosen method, procedure and sales terms of such property.

3. Approve Regulations on Committee of Fund of guaranteeing household deposits concerning consolidation and asset sale which are applied.

4. Approve Changes in some regulatory legal acts of Fund of guaranteeing household deposits which are attached.

5. To provide to department of strategy and normative and methodological providing together with legal department submission of this decision to the Ministry of Justice of Ukraine for state registration.

6. This decision becomes effective from the date of, its official publication following behind day.

7. To provide to department of public relations and financial education placement of this decision on the official page of Fund of guaranteeing household deposits on the Internet after its state registration.

8. Control over the implementation of this decision to assign S. V to the Deputy managing director Rekrut.

Regulations on Committee of Fund of guaranteeing household deposits concerning consolidation and asset sale

I. General provisions

1. This Provision is developed according to requirements of the Law of Ukraine "About system of guaranteeing household deposits".

2. The committee of Fund of guaranteeing household deposits concerning consolidation and asset sale (further - Committee) is permanent collegiate organ of Fund of guaranteeing household deposits (further - Fund) to which executive directorate Fonda delegated separate powers on the organization of asset sale (property) of banks which are liquidated.

3. The committee performs the activities based on the laws of Ukraine, regulatory legal acts of Fund, decisions of executive directorate of Fund and this provision.

4. The main objectives of Committee are:

1) determination of terms and actions of pre-sale preparation of assets (property) of the liquidated banks;

2) determination of methods, procedure and sales terms of assets (property) of the liquidated banks;

3) preliminary consideration of documents and drafts of decisions which are submitted for consideration of executive directorate of Fund for questions of asset sale (property) of the liquidated banks;

4) ensuring coordination of work of structural divisions and authorized persons of Fund on liquidation of banks regarding asset sale (property) of the liquidated banks;

5) provision of recommendations about modification of regulatory legal acts of Fund regarding asset sale (property) of the liquidated banks.

The committee realizes the tasks concerning asset (property), lot, asset pool (property) which book value (which) there are less than 100 million UAH and which initial price / sales price (which) is smaller or equal book or estimated value (for rights to claim according to credit agreements - smaller or equal debt on the following agreements (debt on principal debt, the added percent, and also the commission fees provided by the agreement) or estimated value).

5. Committee according to the tasks assigned to it:

Approves 1) according to requirements of the laws and regulatory legal acts of Fund for questions of asset sale (property) of the liquidated bank:

terms and actions of pre-sale preparation of individually certain asset (property) (lot, asset pool (property)) bank(s) which is liquidated (yutsyatsya);

the method, procedure and sales terms of individually certain asset (property) (lot, asset pool (property)) bank(s) which is liquidated (yutsyatsya);

2) previously considers documents and drafts of decisions which are submitted for consideration of executive directorate of Fund for questions of asset sale (property) of the liquidated banks;

3) coordinates work of structural divisions and authorized persons of Fund on liquidation of banks regarding asset sale (property) of the liquidated banks;

4) develops the concept and recommendations about modification of regulatory legal acts of Fund regarding asset sale (property) of the liquidated banks;

5) hears periodic (if necessary) reports of heads of structural divisions of Fund and/or authorized persons of Fund on liquidation of banks for the purpose of control over the implementation of the decisions made by Committee.

II. Structure of committee

1. The chairman of Committee, his deputies and members of the committee are part of Committee.

2. The staff of Committee affirms executive directorate of Fund.
