About questions of certification of engineers land surveyors and surveying engineers

According to articles 66-1 and 68 of the Law of Ukraine "About land management", to articles 5-1, 5-2 and 24 of the Law of Ukraine "About land and cartographic activities", to Item 3 of the Section II "Final and transitional provisions" of the Law of Ukraine of October 2, 2012 No. 5394-VI "About modification of some legal acts of Ukraine concerning deregulation of economic activity on work on land management and zemleotsenochny works" I order:

1. Approve the Operating procedure of the Qualification commission, issue and cancellation of the qualification certificate of the engineer land surveyor and surveying engineer who is applied.

2. Approve document forms which are attached:

the qualification certificate of the engineer land surveyor which is issued by Public service of Ukraine concerning geodesy, cartography and the inventory;

the statement from the State register of the certified engineers land surveyors;

the statement from the State register of the certified surveying engineers.

3. The statement for receipt of the statement from the State register of the certified engineers land surveyors and/or the certified surveying engineers can be submitted to Gosgeokadastr in paper or electronic type (through the official site of Gosgeokadastr) taking into account the Law of Ukraine "About administrative services". Information from the State register in the form of the statement is sent to the address specified by the subject of the address.

4. To provide to department of agriculture and technical policy in the AIC in the procedure established by the legislation submission of this order on the state registration in the Ministry of Justice of Ukraine.

5. This order becomes effective from the date of its official publication.

Operating procedure of the Qualification commission, issue and cancellation of the qualification certificate of the engineer land surveyor and surveying engineer

I. General provisions

1. This Procedure determines the basic principles of work of the Qualification commission, the procedure of issue and cancellation of the qualification certificate of the engineer land surveyor and surveying engineer.

2. The structure of the Qualification commission affirms Gosgeokadastr's order. The Qualification commission 10 people from among highly qualified specialists who are Gosgeokadastr's representatives, 5 people from among representatives of educational institutions, 5 people from among representatives of self-regulatory organizations in the field of land management are included. The term of office of members of the Qualification commission constitutes 7 years.

Before recognition in accordance with the established procedure of self-regulatory organizations in the field of land management Gosgeokadastr for ensuring public regulation of land management, including ensuring work of the Qualification commission, has the right to involve the highly qualified specialists delegated by the associations of citizens, associations, educational institutions performing public, professional and educational work in the field of land management.

3. Members of the Qualification commission elect the chairman and the secretary from the structure.

4. The member of the Qualification commission can be excluded from its structure at own will, in case of his death, the introduction in legal force of the judgment about deprivation (restriction) of freedom or assignment of other punishment which makes impossible membership in the Qualification commission, recognition of person is limited capable or incapacitated, losses by person of citizenship of Ukraine.

5. Treat powers of the Qualification commission:

consideration of the applications, the documents and materials which arrived in the Qualification commission, decision making about the admission of persons who filed the specified documents to passing qualification examination;

the organization and holding qualification examinations of the physical persons wishing to receive the qualification certificate of the engineer land surveyor and/or surveying engineer;

establishment of requirements to programs of advanced training of the certified engineers land surveyors and surveying engineers;

control of quality of professional training of the certified engineers land surveyors and surveying engineers;

approval of the list of questions to qualification examinations and in case of need modification of the specified list;

decision making about issue of the qualification certificate of the engineer land surveyor and/or surveying engineer, their duplicates;

consideration of written addresses of interested persons, customers of documentation on land management, public authorities and local self-government, self-regulatory organizations in the field of land management and geodetic and cartographic activities on professional activity of the certified engineers land surveyors and surveying engineers, and also the statements which are drawn up by results of the events of the state supervision (control) held by Gosgeokadastr;

decision making about introduction of representation to Gosgeokadastr about cancellation or suspension of action of the certificate of the engineer land surveyor and/or surveying engineer;

in case of need the appeal to the relevant authorized bodies for the purpose of the solution of the questions which are within its competence.

6. Organizational technical supply of activities of the Qualification commission is performed by Gosgeokadastr.

7. Programs of advanced training develop educational institutions which signed the contract with Gosgeokadastr. The specified programs shall provide receipt of additional knowledge and abilities from the latest developments in the field of land management and geodetic and cartographic activities.
