About approval of the Operating procedure of the commission of the Public fiscal service of Ukraine which makes the decision on registration of tax superimposed / calculating adjustment in the Unified register of tax delivery notes or refusal in such registration

According to Item 201.16 of Article 201 of the Section V of the Tax code of Ukraine and Regulations on the Ministry of Finance of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 375, I order:

1. Approve the Operating procedure of the commission of the Public fiscal service of Ukraine which makes the decision on registration of tax superimposed / calculating adjustment in the Unified register of tax delivery notes or refusal in such registration which is applied.

2. In accordance with the established procedure to provide to department of tax policy of the Ministry of Finance of Ukraine and Department of monitoring of the income and accounting and reporting systems of the Public fiscal service of Ukraine:

provision of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

3. This order becomes effective from the date of its official publication.

4. I reserve control of execution of this order and I assign to the acting as the Chairman of the Public fiscal service of Ukraine M. V Is sold.

Operating procedure of the commission of the Public fiscal service of Ukraine which makes the decision on registration of tax superimposed / calculating adjustment in the Unified register of tax delivery notes or refusal in such registration

1. This Procedure determines organizational and procedural bases of activities of the commission of the Public fiscal service of Ukraine which make the decision on registration of tax superimposed / calculating adjustment in the Unified register of tax delivery notes or refusal in such registration (further the Commission), and also the rights and obligations of her members.

2. The commission is permanent collegiate organ under GFS which is effective within the powers determined by Item 201.16 of Article 201 of the Section V of the Tax code of Ukraine and the resolution of the Cabinet of Ministers of Ukraine of March 29, 2017 No. 190 "About establishment of the bases for decision making of the Public fiscal service by the commission about registration of tax superimposed / calculating adjustment in the Unified register of tax delivery notes or about refusal in such registration".

3. The commission in the activities is guided by the Constitution of Ukraine, the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine accepted according to the Constitution of Ukraine, the Tax code of Ukraine and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation, and also this Procedure.

4. Documentation of activities of the Commission is performed in state language.

5. The Commissions are included officials of GFS.

6. The commission consists of the chairman, the vice-chairman, the secretary and at least seven members.

7. The commission chairman and her members affirms GFS.

8. The commission chairman will organize its work and bears responsibility for accomplishment of the tasks and functions assigned to the Commission, presides over its meetings and determines circle of the questions which are subject to consideration.

The commission chairman determines functional obligations of each member of the commission. In case of absence of the commission chairman of its obligation the vice-chairman of the Commission performs. In case of absence of the commission chairman and his deputy of obligation of the commission chairman one of members of the commission elected by the Commission performs.

9. The secretary of the Commission provides preparation of holding the meetings and materials which are subject to consideration on commission sessions, maintaining protocols of commission sessions.

In case of absence of the secretary of the Commission of its obligation one of members of the commission elected by the Commission performs.

10. The member of the commission has the right:

1) to get acquainted with the materials submitted for consideration to the Commission and to participate in their check;

2) to look through all information concerning taxpayers on the value added which is available in GFS;

3) to make offers, to express own opinion on cases in point;

4) to express the special opinion which is drawn up in writing;

5) to make offers in the agenda of commission session.

11. The member of the commission shall:

1) personally to participate in work of the Commission;

2) not to disclose the data, become to it known in connection with participation in work of the Commission and not to exploit them or interests of the third parties;

To carry out 3) in the limits provided by this Procedure, orders of the Commission chairman;

4) it is obligatory to participate in vote.
