About approval of Rules of forming and maintaining registers in the sphere of public procurements

According to the subitem 9) article 16 of the Law of the Republic of Kazakhstan of December 4, 2015 "About public procurements" PRIKAZYVAYU:

1. Approve the enclosed Rules of forming and maintaining registers in the sphere of public procurements.

3. (Akhmetov S. M.) in the procedure established by the legislation to provide to department of the legislation of public procurements of the Ministry of Finance of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let, and also in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan.

4. This order becomes effective since January 1, 2016 and is subject to official publication.

Rules of forming and maintaining registers in the sphere of public procurements

1. General provisions

1. These rules of forming and maintaining registers in the sphere of public procurements (further – Rules) are developed according to the Law of the Republic of Kazakhstan of December 4, 2015 "About public procurements" (further – the Law) and determine procedure for forming and maintaining registers in the sphere of public procurements.

2. Registers in the sphere of public procurements are created and kept by authorized body on public procurements (further – authorized body) in the Kazakh and Russian languages, in electronic form by means of the web portal of public procurements (further – the web portal) and shall conform to requirements of article 12 of the Law.

3. The data containing in registers in the sphere of public procurements except for of the data constituting the state secrets according to the legislation of the Republic of Kazakhstan on the state secrets and (or) containing the office information of limited distribution determined by the Government of the Republic of Kazakhstan are placed on the web portal and are available to acquaintance to interested persons without collection of payment.

2. Types of registers in the sphere of public procurements

4. Registers in the sphere of public procurements (further - registers) are subdivided into the following types:

1) register of customers;

2) register of agreements on public procurements;

3) register of unfair participants of public procurements;

4) register of skilled potential suppliers;

5) register of claims.

3. Procedure for forming and maintaining register of customers

5. The register of customers contains the following information about the customer:

1) name of the customer;

2) date of state registration (re-registration) of the customer;

3) business and identification number (BIN);

4) data on territorial accessory of the customer (code on the qualifier of administrative-territorial associations (QATA), the region, legal address);

5) name of the administrator of the reporting;

6) code organizationally legal form of managing (KOPF);

7) code on the qualifier of patterns of ownership (QPO);

8) category of the subject of entrepreneurship;

9) code of the sector of economy;

10) information about the customer's head:

individual identification number (IIN);

surname, name, middle name (in the presence) head;

head's position;

data source;

e-mail;

phone (working, mobile).

6. Forming of the register of customers is performed automatically by means of the web portal based on registration data of the customer on the web portal.

At the same time the customer is registered on the web portal no later than three working days from the date of its state registration in judicial authorities. In case of reorganization (liquidation) or change of registration data of the customer in judicial authorities the customer in time no later than ten working days from the date of registration of such cases in judicial authorities enters the changed data in registration data of the customer on the web portal.

7. Maintaining the register of customers is performed by means of the web portal in form according to appendix 1 to these rules.

4. Procedure for forming and maintaining register of agreements on public procurements

9. Entering into the register of agreements on public procurements of data is performed by the customer by filling of electronic form of the register of agreements on the web portal of public procurements in form according to appendix 2 to these rules on:

to the signed agreements on public procurements in the corresponding financial year – no later than ten working days from the date of entry into force of the agreement on public procurements;

to agreement performance about public procurements (the act of acceptance - transfers of goods or the act of the performed works, the rendered services) – no later than ten working days from the date of signing;

to effected payments under agreements on public procurements – no later than ten working days from the date of carrying out payment.
