Agreement between the Government of the Republic of Kazakhstan and Government of Turkmenistan on mutual trips of citizens

of March 1, 2001

The government of the Republic of Kazakhstan and the Government of Turkmenistan which are hereinafter referred to as with the Parties, being guided by the aspiration to settle procedure for mutual trips of citizens of the states, agreed as follows:

Article 1

Citizens of the state of one Party can drive, leave, follow en route and stay temporarily in the territory of the state of other Party according to the valid documents listed in Appendices 1 and 2 to this agreement and on the terms of provided by this agreement.

Article 2

1. The citizens of the state of one Party who are owners of the valid diplomatic or service passports can drive, leave, follow en route and stay in the territory of the state of other Party without execution of visas within 30 days from the moment of crossing of border.

2. If the citizens of the states of the Parties specified in Item 1 of this Article intend to stay in the territory of the state of other Party more than 30 days, receipt of a visa requires the written appeal of diplomatic representation or consular establishment of the state of the Party which citizens they are.

Article 3

1. The citizens of the state of one Party owning diplomatic or service passports and being the staff of the diplomatic representations and consular establishments, official representations and also the international organizations which are in the territory of the state of other Party drive, leave and stay in the territory of the state of other Party without visas during the entire period of work.

Specified persons shall have the corresponding accreditation of the Ministry of Foreign Affairs of the state of stay.

2. Provisions of Item 1 of this Article extend also to members of families of the persons mentioned in it and which are owners of diplomatic, service and national passports.

Article 4

1. The citizens of the Republic of Kazakhstan who are constantly living in the Atyrau and Mangystau areas of the Republic of Kazakhstan can drive, leave and temporarily stay in the territory of Balkan Region of Turkmenistan without execution of visas for the term of no more than 5 days according to national passports and in the presence of the identity certificate of the citizen of the Republic of Kazakhstan confirming their residence in the specified areas of the Republic of Kazakhstan.

2. The citizens of Turkmenistan who are constantly living in Balkan Region of Turkmenistan can drive, leave and temporarily stay in the territories of the Atyrau and Mangystau areas of the Republic of Kazakhstan without execution of visas for the term of no more than 5 days according to national passports in the presence in them the stamp about registration confirming their residence in the specified welayat of Turkmenistan.

3. The term of the 5th daily visa-free stay of the citizens specified in Items 1 and 2 of this Article is estimated from the moment of registration of specified persons in destination by law-enforcement bodies according to established procedure.

4. Stay of citizens of the states of the Parties called in Items 1 and 2 of this Article and in the specified territories of the states of the Parties, more than 5 days is allowed based on the visas issued by authorized bodies of the states of the Parties according to their national legal systems.

Article 5

The visa-free procedure for entrance according to the documents listed in Appendices 1 and 2 of this agreement remains for:

a) members of crews of aircrafts of civil aviation according to national passports and in the presence of entry in the general declaration (flight task);

b) members of crews of ocean and river crafts according to passports of seamen and in the presence of entry in the muster roll or the statement from it;

c) workers of train, refrigerator and locomotive crews of the railroads according to the national passports and personalized lists, route sheets approved on each flight;

d) employees of intergovernmental courier communication according to national passports and in the presence of the certificate of the employee of intergovernmental courier communication.

Article 6

Citizens of the state of one Party for receipt of a visa of the state of other Party show in diplomatic representation or consular establishment of the host state the invitation which is drawn up in accordance with the established procedure and received from the relevant legal entity or physical person of the state of visit, except as specified, specified in this agreement.

Article 7

1. Authorized bodies of the states of the Parties will issue the multi-visas valid for up to one year, to persons having the close relatives who are constantly living in the territory of the host state on presentation of invitations from these relatives who are drawn up according to the legislation of this state.
