About approval of Rules of revenues to civil service and carrying out tender on occupation of vacant position of the civil servant

According to the subitem 23) Article 16 of the Labor code of the Republic of Kazakhstan of November 23, 2015 PRIKAZYVAYU:

1. Approve the enclosed Rules of revenues to civil service and carrying out tender on occupation of vacant position of the civil servant.

2. To provide to department of work and social partnership of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. Declare invalid the order of the Minister of health and social development of the Republic of Kazakhstan of May 21, 2015 No. 365 "About approval of Rules of revenues to civil service and carrying out tender on occupation of vacant position of the civil servant" (registered in the Register of state registration of regulatory legal acts for No. 11464, published in information system of law of Ad_let of July 16, 2015).

4. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Nurymbetov B. B.

5. This order becomes effective since January 1, 2016 and is subject to official publication.

Rules of revenues to civil service and carrying out tender on occupation of vacant position of the civil servant

1. General provisions

1. These rules of revenues to civil service and carrying out tender on occupation of vacant position of the civil servant (further - Rules) are developed according to the subitem 23) of Article 16 of the Labor code of the Republic of Kazakhstan of November 23, 2015 (further - the Code) and determine procedure for revenues to civil service and carrying out tender on occupation of vacant position of the civil servant.

2. Tender on occupation of vacant position of the civil servant (further - competition) will be organized and carried out by the public institution, the state company having vacant position (further - the organization).

3. The main requirements in case of selection of the candidate for position of the civil servant are education on necessary profile, the professional training level, and also compliance to the qualification requirements imposed to civil servants (further - qualification requirements).

4. Qualification requirements to workers and complexity of certain work types are established on the basis of the Single wage rate book of works and professions of work, tariff and qualification characteristics of professions of workers, the Job evaluation catalog of positions of heads, specialists and other employees, and also standard qualification characteristics of positions of heads, specialists and other employees of the organizations according to the subitem 16) of article 16 of the Code.

5. Revenues to civil service are performed according to the decision of the employer according to the procedure of appointment or on tender.

6. Acceptance on civil service is performed by execution of an employment agreement and the publication of the act of the employer.

The basis for acceptance on civil service on tender is the positive conclusion of the contest committee (further - the commission).

For position assignment of the civil servant the applicant submits to the organization documents, stipulated in Item 1 article 32 of the Code.

7. The procedure for consideration, coordination and introduction of representation of the organization to the head for appointment of the applicant to position of the civil servant is established by internal acts of the organization.

8. Position assignment of the civil servant is performed on condition of compliance of person to imposed qualification requirements to the corresponding vacant position.
