About approval of the Procedure for creation and representation of requests for receipt of public information which manager is the Public assay service of Ukraine

According to Articles 19, 20 Laws of Ukraine "About access to public information", Article 2 of the Presidential decree of Ukraine of May 5, 2011 No. 547 "Questions of ensuring with executive bodies of access to public information", Item 4 of the resolution of the Cabinet of Ministers of Ukraine of May 25, 2011 No. 583 "Questions of accomplishment of the Law of Ukraine "On access to public information" in the Secretariat of the Cabinet of Ministers of Ukraine, central both local executive bodies" and the subitem 3 of Item 10 of the Regulations on the Ministry of Finance of Ukraine approved by the Presidential decree of Ukraine of April 8, 2011 No. 446, for the proper organization of access to public information which manager is the Public assay service of Ukraine, PRIKAZYVAYU:

1. Approve the Procedure for creation and representation of requests for receipt of public information which manager is the Public assay service of Ukraine which is applied.

2. Approve the Form for representation of request for receipt of public information which is attached.

3. To management of communications (Press service) of the Ministry of Finance of Ukraine (Kosarchuk V. P.), to the sector of legal support of the Public assay service of Ukraine (Polishchuk A. S.) to provide in accordance with the established procedure:

Submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the Deputy Minister of Finance of Ukraine - the chief of staff of Shevchenko Yu. I. and vice-chairman of the Public assay service of Ukraine Nikolayenk N. I.

Procedure for creation and representation of requests for receipt of public information which manager is the Public assay service of Ukraine

I. General provisions

1.1. This Procedure is developed according to the Law of Ukraine "About access to public information" (further - the Law), the Presidential decree of Ukraine of May 5, 2011 No. 547 "Questions of ensuring with executive bodies of access to public information" and the resolution of the Cabinet of Ministers of Ukraine of May 25, 2011 No. 583 "Questions of accomplishment of the Law of Ukraine "On access to public information" in the Secretariat of the Cabinet of Ministers of Ukraine, central and local executive bodies" for the purpose of creation of mechanisms of realization of the right of everyone to access to public information.

The right to access to public information is guaranteed by the maximum simplification of the procedure of representation of request for receipt of public information.

1.2. In this Procedure terms are used in the values given in the Law.

1.3. Manager of public information according to the Law is the Public assay service of Ukraine (further - Assay service).

1.4. Access to public information is provided by provision of information on requests for receipt of public information.

1.5. Physical, legal entities and associations of citizens without the status of the legal entity, except subjects of powers of authority are requesting public information according to the Law when implementing of the functions by them.

1.6. The relations in the field of addresses of citizens are governed by the Law of Ukraine "About the address of citizens".

II. Creation and representation of requests for receipt of public information

2.1. Requesting has the right to make in Assay service inquiry for receipt of public information irrespective of, this information concerns it personally or not, without explanation of the reason of representation of request.

2.2. The request for receipt of public information can be individual or collective.

2.3. The request for receipt of public information is sent to Assay service in oral or written form during personal acceptance or departure siding by mail, to the telefax, e-mail or by phone at choice of requesting.

2.4. The written request on receipt of public information is sent in any form.

2.5. The request for receipt of public information shall contain:

surname, name, middle name (name) requesting, the postal address, the e-mail address, number of the means of communication, if any;

the general description of information or type, the name, details or contents of the document concerning which the request is made if requesting it it is known;

the signature and date on condition of submission of the written request.
