The government of the Russian Federation and the Government of the Republic of Byelorussia which are hereinafter referred to as with the Parties

being guided by the Agreement on creation of the Union State of December 8, 1999, the Agreement between the Government of the Russian Federation and the Government of the Republic of Belarus on cooperation in the field of culture, science and education of February 21, 1995, the Agreement on cooperation on forming of single (general) educational space of the Commonwealth of Independent States of January 17, 1997,

for the purpose of creation of optimum conditions for further interaction in development of education and cultures of the people of both states

agreed as follows:

Article 1

The parties establish in the city of Mogilev (Republic of Byelorussia) the Russian-Belarusian university (further referred to as - university).

The university is the state higher educational institution of joint maintaining the Russian Federation and the Republic of Byelorussia, uses the status of the state universities of the Russian Federation and the Republic of Byelorussia.

Article 2

The main objectives of university are:

satisfaction of educational needs of the personality, preparation, retraining and advanced training of specialists with the higher education technical, economic, natural-science and on separate specialties of humanitarian profile, and also research and educational personnel;

assistance to development of scientific and personnel capacity of both states by attraction for work at university of research and educational personnel from the Russian Federation and the Republic of Byelorussia;

use of the advanced educational and methodical technologies and use of the achievements and experience which is saved up in the fields of education and sciences in the Russian Federation and the Republic of Byelorussia;

assistance to development and mutual enrichment of cultures, languages, historical and national traditions of the people of both states.

Article 3

Training languages at university establish the Russian and Belarusian languages.

Article 4

The parties create the standing joint Russian-Belarusian working group of representatives of the Ministry of Education of the Russian Federation and the Ministry of Education of the Republic of Byelorussia, and also other interested state bodies for the solution of questions of educational and methodical, material, financial provision of activities of university.

Article 5

The Belarusian Side provides to university of the building, construction, student residences, the parcels of land or ready objects under educational, sports, treatment-and-prophylactic and cultural institutions of university, and also renders assistance in creation of social conditions for the invited scientific and pedagogical workers in accordance with the legislation of the Russian Federation and the Republic of Byelorussia.

Article 6

Financial provision of activities of university is performed due to the assignments provided in expenses for education to the Ministry of Education of the Russian Federation and the Ministry of Education of the Republic of Byelorussia on the equity beginnings.

Use in financial provision of activities of university of voluntary contributions from legal entities and physical persons and other sources of financing according to legislations of both states is allowed.

Article 7

The university according to the tasks set for it takes part in accomplishment of the scientific programs and projects financed by the Russian Federation and the Republic of Byelorussia, and also humanitarian funds of both states and foreign countries.

Article 8

Activities of university are regulated by its charter approved by the Ministry of Education of the Russian Federation and the Ministry of Education of the Republic of Byelorussia.

Article 9

By the charter of university creation of the board of trustees as a part of eminent state and public figures, educators, sciences and cultures of Russia and Belarus can be provided.

Article 10

Educational activities at university, its licensing, accreditation and certification are performed on the basis of joint decisions of the Ministry of Education of the Russian Federation and the Ministry of Education of the Republic of Byelorussia.

Article 11

The common directorship and direct control of university before forming according to its charter of the academic council is exercised by the rector appointed by the joint order of the Ministry of Education of the Russian Federation and the Ministry of Education of the Republic of Byelorussia.

Article 12

Persons having general secondary (complete) or secondary professional (special) education irrespective of nationality, nationality, sex, age, the relation to religion, social position and political views have the right of entering a university.

Transfer on training in university is performed according to the procedure, established by the joint decision of the Ministry of Education of the Russian Federation and the Ministry of Education of the Republic of Byelorussia.
