The governments of the State Parties of the Commonwealth of Independent States which further are referred to as with the Parties
for the purpose of ensuring cooperation in creation of compatible national telemedicine systems during the forming and projects implementation and the programs containing actions for their implementation in the State Parties of the CIS
recognizing importance of effective use of national telemedicine systems for the purpose of increase in efficiency of protection of public health, and also enhancement of health care systems of the State Parties of the CIS on the basis of use of modern high technologies and innovations,
proceeding from need of rapprochement of the legislation in the field of development and use of compatible national telemedicine systems, being guided by international treaties in this sphere and legislations of the State Parties of this agreement,
aiming at consecutive implementation of this agreement,
agreed as follows:
The purpose of this agreement is creation of compatible national telemedicine systems of the State Parties of the CIS with the subsequent ensuring their interaction for public and high-quality delivery of health care to the population in the territories of the State Parties of this agreement, irrespective of social position and the residence of their citizens.
For the purposes of this agreement the provided terms have the following values:
telemedicine - complex of the organizational, financial and technological actions providing implementation of remote consulting medical service in case of which the patient or the doctor who is directly conducting examination or treatment of the patient gets remote advice of other doctor with use of the information and communication technologies which are not contradicting national standards;
telemedicine services - remote delayed medical consultations, consultations in real time, control of physiological parameters of organism of the patient, carrying out diagnostic and medical manipulations, exchange of results of inspection of the patient, other medical services, and also the medical videoconferences, teleconsultations, teleseminars, telelectures performed with use of information and communication technologies;
compatible national telemedicine system - the national system of rendering telemedicine services providing effective interaction with national telemedicine systems of other states on the basis of use of international standards in the sphere of telemedicine.
The parties create compatible national telemedicine systems or provide compatibility of the existing national telemedicine systems for the purpose of providing in the State Parties of this agreement of conditions for rendering qualified telemedicine services in case of the security of the rights and legitimate interests of physical persons and legal entities guaranteed by the states in the course of obtaining and provision of medical care.
The main objectives of creation of compatible national telemedicine systems are:
ensuring general availability and high quality standard of medical attendance;
servicing of the population and rendering high-quality medical care to the population irrespective of the residence;
creation of effective mechanisms of creation and functioning of compatible national telemedicine systems;
the accelerated exchange and implementation in health care of modern medical techniques;
providing effective system of preparation and retraining of medical personnel;
development of the scientific and industrial spheres connected with area of telemedicine;
implementation of various special programs of rendering telemedicine services;
development of normative legal support of cross-border telemedicine services;
preparation, advanced training and certification of specialists in the field of telemedicine.
During creation of compatible national telemedicine systems of the Party comply with the following conditions:
fixation of data on human health without humiliation of advantage of the personality;
informing person on the purpose of collection of specific data;
exception of possibility of illegal reproduction of the data on the person containing in telemedicine systems the violating right of citizens to personal data protection according to the legislation of the State Parties of this agreement;
