DECISION OF BOARD OF THE EUROASIAN ECONOMIC COMMISSION

About the Advisory committee on the public (municipal) procurements

According to Items 7 and 44 of the Regulations on the Euroasian economic commission (appendix No. 1 to the Agreement on the Eurasian Economic Union of May 29, 2014) the Board of the Euroasian economic commission solved:

1. Create the Advisory committee on the public (municipal) procurements.

2. Approve the enclosed Regulations on the Advisory committee on the public (municipal) procurements.

3. Ask the governments of state members of the Eurasian Economic Union in 15-day time from the date of the introduction of this Decision in force to present to the Euroasian economic commission candidacies for inclusion in structure of Advisory committee for the public (municipal) procurements.

4. This Decision becomes effective after 30 calendar days from the date of its official publication.

Regulations on the Advisory committee on the public (municipal) procurements

I. General provisions

1. The advisory committee on the public (municipal) procurements (further - Committee) is created under Board of the Euroasian economic commission (further respectively - Board, the Commission) according to Items 7 and 44  of the Regulations on the Euroasian economic commission (appendix No. 1 to the Agreement on the Eurasian Economic Union of May 29, 2014 (further - the Agreement)).

The committee is consultative body of the Commission on questions of the public (municipal) procurements within the Eurasian Economic Union (further - the Union).

2. The committee in the activities is guided by the Agreement, other international treaties and acts constituting the right of the Union, the Regulations of work of the Euroasian economic commission approved by the Decision of the Supreme Euroasian economic council of December 23, 2014 No. 98, and also this Provision.

II. Main objectives and functions of Committee

3. The main objectives of Committee are:

a) carrying out consultations with representatives of state members of the Union (further - state members) concerning realization of provisions of the Section XXII of the Agreement and the Protocol on procedure for purchasing control (appendix No. 25 to the Agreement) and development of offers for the Commission on questions in the field of the public (municipal) procurements;

b) consideration of questions in the field of the public (municipal) procurements, and also questions on which the Board of the Commission shall hold consultations according to Item 25 of the Regulations on the Euroasian economic commission (appendix No. 1 to the Agreement) before decision making of Board or Council of the Commission;

c) consideration (if necessary) and development of offers on questions in the field of the public (municipal) procurements,

including on the questions requiring further review at meetings of Board or Council of the Commission;

d) consideration of other questions within the competence.

4. For realization of the tasks assigned to it the Committee performs the following functions:

a) carrying out consultations on the most topical issues of law-enforcement practice, enhancement of the legislation of state members and acts of bodies of the Union in the field of the public (municipal) procurements, including for the purpose of removal of obstacles in the domestic market of the Union;

b) consideration of methodical, analytical and information materials and offers on questions in the field of the public (municipal) procurements;

c) consideration and approval of subjects of research works in the field of the public (municipal) procurements for inclusion in the plan of research works of the Commission;

d) consideration (if necessary) results of monitoring of execution by state members of international treaties within the Union and acts of bodies of the Union in the field of the public (municipal) procurements;

e) preparation of offers on creation of expert and working groups or about the termination of their activities;

e) consideration of questions of need of project development of international treaties and other documents for the purpose of development of the sphere of the public (municipal) procurements;

g) implementation of other functions in the field of the public (municipal) procurements within the competence.

III. Structure of Committee

5. The structure of Committee is created of heads (deputy managers) of authorized bodies of the state members performing the regulating and (or) controlling functions in the field of the public (municipal) procurements, and public authorities of the state members authorized on interaction with the Commission (further - authorized bodies), and also of heads (deputy managers) of structural divisions of authorized bodies.

6. By the invitation of the chairman of Committee representatives of public authorities of state members, including according to the offer of state members, business communities, scientific and public organizations, other independent experts having necessary qualification and professional skills and also officials and the staff of the Commission within whose competence the questions considered on committee meeting are can participate in committee meetings.

7. Under Committee if necessary expert and working groups which are created of number of representatives of authorized bodies, officials and the staff of the Commission can be created.

According to the offer of state members the structure of the expert and working groups can join the representatives of business communities, scientific and public organizations, other independent experts having necessary qualification and professional skills.

The operating procedure of expert and working groups is determined by Committee.

8. For forming of structure of Committee (expert and working groups) the Department of competition policy and policy in the field of public procurements of the Commission (further - responsible department) requests from authorized bodies of the offer on candidates for inclusion in structure of Committee (expert and working groups).

Authorized bodies timely inform Board of the Commission on need of replacement of representatives of authorized bodies for Committee.

The structure of Committee affirms the order of Board of the Commission.

9. Presides over committee meetings and the member of Board (Minister) of the competition and anti-monopoly regulation of the Commission performs the common directorship of work of Committee (further - the chairman of Committee).
