About use of the preliminary information presented in the form of the electronic document

According to items 4 and the 17th Articles 11, Item 7 of Article 105 and the paragraph the fourth item 4 of Article 278 of the Customs code of the Eurasian Economic Union the Board of the Euroasian economic commission solved:

1. Approve the enclosed Procedure for use of the preliminary information presented in the form of the electronic document.

2. Determine the following customs transactions when which making the preliminary information presented in the form of the electronic document is used:

a) receipt of permission of customs authority of state member of the Eurasian Economic Union (further respectively – state member, the Union) on implementation in the place of arrival of unloading, overload (transfer) and other cargo operations with goods, and also replacements of the vehicles of international delivery which delivered goods on customs area of the Union, other vehicles;

b) the notification of customs authority of state member on implementation in the place of arrival of unloading, overload (transfer) and other cargo operations with goods, and also replacements of the vehicles of international delivery which delivered goods on customs area of the Union, other vehicles if such notification is submitted in the cases established by the legislation of state members on customs regulation and (or) international treaties of state members with the third party.

3. This Decision becomes effective since July 1, 2019.

Procedure for use of the preliminary information presented in the form of the electronic document

I. General provisions

1. This Procedure determines rules of use of the preliminary information presented in the form of the electronic document (further – the preliminary information), before arrival of goods on customs area of the Eurasian Economic Union (further – the Union) and after their arrival on such territory for risks assessment and adoption of provisional solutions about the choice of objects and forms of customs control, the measures providing its carrying out, and also when making the customs transactions specified in the subitem "an" of Item 2 presents of the Procedure or as the transit declaration and (or) the declaration on the vehicle.

2. The preliminary information is used:

a) when making the customs transactions connected with:

the notification of customs authority of state member of the Union (further respectively – customs authority, state member) about arrival of goods on customs area of the Union;

receipt of permission of customs authority to implementation of unloading of goods in the place of arrival or the notification of customs authority on implementation of unloading of goods in the place of arrival if such notification is submitted in the cases established by the legislation of state members on customs regulation and (or) international treaties of state members with the third party (further – the notification of customs authority on implementation of unloading of goods in the place of arrival);

receipt of permission of customs authority to implementation of overload (transfer) of goods and other cargo operations with goods, and also replacements of the vehicles of international delivery which delivered goods on customs area of the Union, other vehicles (further – cargo operations with goods and (or) replacement of vehicles) in the place of arrival or the notification of customs authority on implementation of cargo operations with goods and (or) replacements of vehicles together arrivals if such notification is submitted in the cases established by the legislation of state members on customs regulation and (or) international treaties of state members with the third party (further – the notification of customs authority on implementation of cargo operations with goods and (or) replacements of vehicles in the place of arrival);

goods placement on temporary storage;

b) as the transit declaration;

c) as the declaration on the vehicle.

3. The preliminary information provided before arrival of goods on customs area of the Union and certified by the electronic digital signature (digital signature) according to the legislation of that state member to which customs authority it is represented is used regardless of the terms of its representation determined by the Euroasian economic commission (further – the Commission) according to Item 17 of Article 11 of the Customs code of the Eurasian Economic Union (further – the Code).

4. For the purpose of verification of the data containing in the preliminary information, customs authorities use information obtained from other information systems, including from information systems of persons specified in Item 1 of article 362 of the Code within information exchange of information systems of customs authorities and information systems of such persons.

II. Procedure for use of the preliminary information before arrival of goods on customs area of the Union

5. After registration of the preliminary information customs authority with use of information systems, including using risk management system:

a) reveals goods when which importing to customs area of the Union prohibitions and restrictions can be applied;

b) reveals goods concerning which when importing to customs area of the Union the state control (supervision) shall be exercised;

c) determines measures for risk minimization.

6. In case of identification of goods concerning which when importing to customs area of the Union it shall be performed sanitary and epidemiologic veterinary, phytosanitary quarantine control (supervision), customs authority creates also in the shortest terms, but no later than 15 minutes from the moment of registration of the preliminary information, sends to the authorized bodies of the state exercising the state control (supervision) on customs border of the Union (further – authorized bodies), data from the preliminary information.
