About activities of boundary representatives

The government of the Republic of Uzbekistan and the Government of the Kyrgyz Republic which further are referred to as with the Parties

being guided by the principles of international law about territorial integrity and inviolability of Frontiers,

based on the Contract on eternal friendship between the Republic of Uzbekistan and the Kyrgyz Republic of December 24, 1996,

aiming to develop good-neighbourhood and to support cooperation on providing the mode of Frontier between the Republic of Uzbekistan and the Kyrgyz Republic (further - Frontier),

recognizing the inalienable right of both independent states, to take measures for protection of the Frontiers,

noting need of participation of boundary representatives of the Republic of Uzbekistan and the Kyrgyz Republic for the prevention of borderline cases and conflicts, and in case of their origin - in ensuring bystry investigation and settlement of those,

agreed as follows:

Article 1

1. This agreement regulates activities of boundary agents of the parties for the solution of the questions connected with settlement of borderline cases and conflicts on Frontier.

2. Boundary representatives and deputy boundary representatives of the Republic of Uzbekistan and the Kyrgyz Republic are appointed according to the national legal system of the states of the Parties. Inform each other on appointment of boundary representatives and their deputies of the Party through diplomatic channels with indication of their surnames, names and otechestvo, military ranks, sites of activities and places of stay.

In case of fulfillment of duties of boundary representatives their deputies have the rights which are granted to boundary representatives.

Article 2

Boundary representatives carry out the obligations in cooperation with each other, according to the national legal system of the states and international treaties which participants are the Republic of Uzbekistan and the Kyrgyz Republic, and also the powers determined by this agreement within sites of Frontier. In case of change of sites of activities of the boundary agent of the party inform on this each other through diplomatic channels.

Written powers (appendix No. 1 to this agreement) are issued:

to boundary representatives of the Republic of Uzbekistan and their deputies - the vice-chairman of Service of homeland security - the commander of border troops of SNB of the Republic of Uzbekistan;

to boundary representatives of the Kyrgyz Republic and their deputies - the Chairman of the State Border Service of the Kyrgyz Republic.

Article 3

For ensuring activities of boundary representatives assistants, secretaries, translators, representatives for reception-transmission of office correspondence are appointed, and also experts and other persons are involved.

Assistants to boundary representatives carry out the obligations determined by boundary representatives.

Written powers of assistants to boundary representatives, certificates of secretaries and translators, certificates on one-time crossing of the border in both parties (appendices No. No. 2 - 4 to this agreement) are issued by boundary representatives.

Article 4

Boundary representatives in limits of sites of the activities:

perform necessary measures for the prevention of borderline cases and the conflicts and their settlement in case of origin;

control observance of the states of the Parties of rules of crossing of Frontier established by the national legal system and take measures for prevention of its crossing with violation of statutory rules;

take necessary measures for fight against smuggling together with competent state bodies;

together with competent state bodies take measures for deportation (transfer) of illegal migrants, including from the third countries if there are proofs of their entrance from the territory of the state of other Party;

participate in case of need in identification of corpses of people and take measures for their mutual transfer;

provide together with authorized bodies of public administration and environmental protection control of carrying out economic works and implementation of other activities on Frontier, and also behind water use in boundary reservoirs, observance of rules of hunting and fishery;

timely inform each other on threats of distribution through Frontier of the fires, epidemics, epizooty and agricultural wreckers;

resolve other issues connected with providing the mode of Frontier within the powers conferred by this agreement and the national legal system of the states of the Parties.

Article 5

1. Boundary representatives carry out joint operation, as a rule, by holding meetings (meetings). By agreement between boundary representatives meetings of their deputies and assistants can be held.

2. The meeting (meeting) of boundary representatives is held according to the proposal of one of them. The offer shall contain the agenda of meeting (meeting), the list of participants, the place and time of his (her) carrying out.

In some cases according to the mutual arrangement between boundary representatives, at meeting (meeting) the questions which are earlier not offered for discussion can be considered.
