The governments of the State Parties of this agreement which further are referred to as with the Parties
performing interaction in case of accomplishment of provisions of the Agreement on carrying out coordinated policy in the field of standardization, metrology and certification of March 13, 1992,
considering economic feasibility of cooperation on ensuring reliability of the applied documents on interstate standardization and unities of the principles of their distribution,
being interested in effective activities of national authorities for standardization,
proceeding from need of further development of interstate standardization, expansion of distribution and use of documents on interstate standardization,
agreed as follows:
The purpose of this agreement is forming of the single principles of document distribution on interstate standardization accepted by Interstate council on standardization, metrology and certification (MGS).
For the purposes of this agreement the provided terms have the following values:
documents on interstate standardization - the interstate standards accepted by MGS, rules and recommendations about interstate standardization, interstate qualifiers of technical and economic and social information and change to them, and also their transfers and projects;
document distribution on interstate standardization - reproduction, copying, transfer of documents on interstate standardization for the purpose of their sale or provision different way, in printing or electronic form, including as a part of collections, bases and databanks, other information resources, including the information resources which are posted online;
national authority on standardization - the body for standardization recognized at the national level which has the right to represent the interests of the state in the field of standardization in the relevant international or regional standardization organization.
The exclusive right on document distribution on interstate standardization is reserved for national authorities on standardization or the organizations authorized by them on which national authorities on standardization inform each other and Bureau according to the MGS standards.
In each State Party of this agreement there can be only one national authority on standardization or the organization responsible for document distribution for interstate standardization authorized by it.
National authorities on standardization or the organizations of the State Parties of this agreement authorized by them inform each other and Bureau according to the MGS standards on the facts of unauthorized document distribution on interstate standardization.
The parties provide protection against unauthorized document distribution on interstate standardization according to the legislation of the states.
Distribution terms of documents on interstate standardization, protection against their unauthorized distribution are determined by procedure for document distribution by interstate standardization which is developed by MGS and affirms the Decision of CIS Economic Council.
Coordination of sales activity of this agreement is performed by Bureau according to the MGS standards in interaction with national authorities on standardization of the State Parties of this agreement.
The changes which are its integral part which are drawn up by the relevant protocol can be made to this agreement in the consent of the Parties and become effective according to the procedure, stipulated in Article the 9th this agreement.
The matters of argument between the Parties arising in case of application and interpretation of this agreement are solved by consultations and negotiations of concerned parties.
This agreement becomes effective from the date of receipt by depositary of the third notification on accomplishment by the Parties of the interstate procedures necessary for its introduction which signed it in force.
For the Parties which performed interstate procedures later this agreement becomes effective from the date of receipt by depositary of the relevant documents.
This agreement after its entry into force is open for accession of any state by transfer to depositary of the document on accession.
For the State Party of the CIS this agreement becomes effective after 30 days from the date of receipt by depositary of the document on accession.
For the state, not being the member of the CIS, this agreement becomes effective after 30 days from the date of receipt by depositary of the last notification on the consent of the states which signed it or joined it on such accession.
