About approval of the Regulations on order of registration of export contracts

According to the Law of the Republic of Uzbekistan "About allowing procedures in the field of business activity" and the Presidential decree of the Republic of Uzbekistan of November 3, 2017 the No. UP-5215 "About Measures for Streamlining of Export Licensing and Import of Specific Goods, and also Registration Export and Examinations of Import Contracts" Cabinet of Ministers decides:

1. Take into consideration that the Presidential decree of the Republic of Uzbekistan of November 3, 2017 No. UP-5215 "About Measures for Streamlining of Export Licensing and Import of Specific Goods, and also Registration Export and Examinations of Import Contracts" to the Ministry of Foreign Trade of the Republic of Uzbekistan assigns registration of contracts (agreements), except for exchange, to commodity export (works, services):

concluded based on decisions of the Government of the Republic of Uzbekistan and intergovernmental agreements;

included in appendix No. 2 to the called Presidential decree of the Republic of Uzbekistan.

2. Approve Regulations on order of registration of export contracts according to appendix.

3. To the Ministry of Foreign Trade of the Republic of Uzbekistan to carry out broad explanatory work among subjects of entrepreneurship about essence and contents of this resolution.

4. To the ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

5. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzagrotekhsanoatholding N. S. Otazhonov and the Foreign Trade Minister of the Republic of Uzbekistan Zh. A. Hodzhayev.

Regulations on order of registration of export contracts

Chapter 1. General provisions

1. This Provision according to the laws of the Republic of Uzbekistan "About allowing procedures in the field of business activity", "About the contractual legal base of activities of business entities", the Presidential decree of the Republic of Uzbekistan of November 3, 2017 No. UP-5215 "About Measures for Streamlining of Export Licensing and Import of Specific Goods, and also Registration Export and Examinations of Import Contracts" determines order of registration of the export contracts signed by subjects of entrepreneurship of the Republic of Uzbekistan in the Ministry of Foreign Trade of the Republic of Uzbekistan (further - authorized body).

2. Export contracts under which the parties in parts or in full fulfilled the contract commitments before entry into force of this Provision are not subject to registration in authorized body.

3. Registration of export contracts and (or) supplementary agreements to them in authorized body is performed according to the scheme according to appendix No. 1 to this Provision.

4. Main objective of registration of export contracts is implementation of monitoring of the prices of the exported goods (works, services), streamlinings of accounting of export of specific goods and the foreign trade reporting.

5. In authorized body export contracts of goods (works, services) are subject to registration:

the Governments of the Republic of Uzbekistan and intergovernmental agreements concluded based on decisions;

No. UP-5215 "About Measures for Streamlining of Export Licensing and Import of Specific Goods, and also Registration Export and Examinations of Import Contracts" included in appendix No. 2 to the Presidential decree of the Republic of Uzbekistan of November 3, 2017.

At the same time the export contracts specified in paragraphs second and third this Item, signed at the commodity and raw exchanges and which are subject to registration at the commodity and raw exchanges, export delivery contracts of the self-produced products made by the companies with foreign investments (except export of the licensed specific goods), are not subject to registration in authorized body.

6. All supplementary agreements to the export contracts which are earlier registered in authorized body according to Item 5 of this Provision, the changing main conditions of export contracts, are subject to registration in authorized body.

7. In this Provision the following basic concepts are used:

the export contract - the contract (agreement) signed between the applicant and legal entity or physical person of foreign state on commodity export (works, services);

the applicant - the subject of entrepreneurship performing commodity export, works (services) and addressed to authorized body for registration of the export contract;

commodity export - customs regime of export in case of which the goods of Uzbekistan are exported out of limits of customs area of the Republic of Uzbekistan without obligation of its return import;

export of works (services) - accomplishment (rendering) of works (services) by the applicant to legal entity or physical person of foreign state irrespective of the place of their accomplishment (rendering);
